RESOLUTION NO. 2007-319
AMENDING VARIOUS POLICIES
WHEREAS, staff has identified the attached list of policies ("Attachments A through D") that are
recommended to be amended,
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL that the attached list of
policies ("Attachments A through D") are hereby amended as noted in the attachments.
ADOPTED by the Plymouth City Council on July 24, 2007.
ATTACHMENT "A"
POLICY RELATING TO THE PROCESSING OF DEMOLITION ORDERS
BY THE CITY
Resolution No. 80-184
March 17, 1980
By law, the City is obligated to eliminate hazards to the public safety and health caused by
dangerous, or hazardous strictures and conditions. To this end, the City attempts to reduce such
hazards through the issuance of demolition orders when appropriate through the City Attorney's
office. To promote cooperation and understanding of this process, as well as provide for an
orderly set of procedures, the Council has directed the preparation of this policy.
Procedures,
The following procedures will be used by the City staff and Council in securing and administering
demolition orders:
I . Whenever a city official learns of a hazardous stricture within the City, the
Building Inspection Depai4meftt Division will be contacted and request an inspection of the
stricture.
2. The Building Inspector will inspect the property and fill out a "Demolition Order -
Building Inspector's Report" commenting about the overall condition of the stricture and take
photographs of the site. The inspector shall attempt to informally discuss his inspection findings
with the property owner at this time.
3. If the Building Inspector's report demonstrates that the stricture fits the legal and
building code definition of a hazardous building as stated defined in M.S. 463. 15, Subdivision 3,
and poses a potential public hazard, steps 4 through 7 will be initiated. If the building is
determined not to be hazardous, the Building Inspector will take necessary actions to remedy
noted deficiencies and file his report together with other documents on the subject property for
future reference.
4. The property owner, owner of record or lien holder will be contacted by certified
letter to advise him of the City's concern that the building be repaired in accordance with
applicable codes. A thirty -day period will be given to the property owner to provide time to
resolve the matter informally without court action. At the end of the thirty -day period, the
building inspector will reinspect to determine whether further action is necessary.
5. If the thirty -day period expires without substantial improvement or demolition
taking place, the Building Inspector's report taget of with pier ifes and a copy of the letter
submitted to the property owner will be sent to the City Attorney's office for the preparation of a
resolution and demolition order for City Council consideration.
6. The item will be scheduled on the City Council's agenda and supplied together with
a cover memorandum summarizing the conditions of the demolition order, as well as any special
circumstances that exist, a resolution, demolition order, Building Inspector's report, pictures and a
copy of the letter efiginally feeeived b� to the property owner.
7. Upon adoption of the resolution, the order will be signed by the r ay and
manage,- aforwarded to the City Attorney's office with a eapy stibmitted to the Building
for the initiation of proceedings according to statute.

POLICY ON SANDING AND THE REMOVAL OF ICE AND SNOW FROM CITY
MAINTAINED STREET SYSTEM

L GENERAL
The City of Plymouth annually budgets fiends for the removal of ice and snow from the
city maintained street system. It is the policy of the City to remove ice and snow in order
to provide for the passage of emergency vehicles and safe travel for the greatest number of
vehicles in a cost effective manner and within the constraints created by funding,

II. POLICY
Each year the Public Works Department, Street Maintenance Division, prepares a map of
the City showing the city maintained street system. The City is divided into routes in
which ice control and snow removal will be performed by City employees and private
firms under contract to the City. The routes are periodically revised to correspond with
budgetary, equipment and personnel resources available. Within each route, the major
streets, which are defined as those roadways with a fiinctional classification of minor
collector or higher order in the current Transporation Plan section of the Comprehensive
Plan, fry -did as well as areas of steep grades that require extra care are identifed.
Equipment is assigned for the control of ice and snow. The start of ice and snow control
operations for any storm is dependent upon immediate and anticipated conditions. The
most critical time periods are weekday morning and evening rush -hours. When feasible,
the City will attempt to remove ice and snow from city maintained major streets prior to
these rush hour periods. Normally major streets and hazardous areas are done first. Once
the priority areas have been plowed and opened, the remaining streets in the residential,
commercial and industrial areas will be plowed and sanded.
Under severe conditions or where weather patterns suggest additional ice and snow, street
may not be plowed "fill width" and residential areas may be delayed. Normally within 24
hours after the city maintained street system is opened, the street maintenance division will
proceed with the final plowing and clearing of residual ice and snow.
III. PROCEDURES
The Superintendent of Streets and Fleet Publie AWfks and Street Supervisor with the
assistance of the Plymouth Police Department, citizen and employee input will identify
particular street problem areas which may vary from storm to storm and season to season.
Public Work Maintenance employees are then notified in accordance with the Public
Works Department schedule for emergency calls and the removal of ice and snow will
commence.
IV. EXCEPTIONS
In the event of equipment failure, extreme snowfall or other unanticipated events including
the necessity of resting snowplow crews, deviation from these standards may be
appropriate.
V. MAILBOXES
In those instances in which the U.S. Postal Service does not provide door to door delivery,
it is necessary for property owners to install mailboxes on city owned right-of-way
immediately adjacent to the street curb. While the installation of mailboxes on City owned
right-of-way is permitted, the mailbox owner assumes all risk of damage except where a
mailbox is damaged through contact by snow removal vehicles. If a mailbox is damaged
due to direct contact by a snow removal vehicle, the City, at its option, will repair or
replace at a cost not to exceed $100.
If a mailbox is damaged due to indirect contact, including the force of snow generated by
the snow removal vehicle, the City will assume no responsibility. lle *''t rtt .vvitt

VI UTILITY STRUCTURES
Except as otherwise provided in any license or franchise agreement, the City will only be
responsible for damage to utility pedestals and transformers within the right-of-way
resulting from direct contact by City snow and ice removal equipment. City liability shall
be limited to actual costs to repair the damages as documented by invoices submitted to
the City by the utility.
VII LANDSCAPING
Landscaping, including nursery and inanimate materials that are installed or encroach on
City owned right-of-way are permitted but the owner assumes all risk of damage. The City
will assume no responsibility for damages incurred as the result of snow removal and ice
control activities except that the City, at its option, will repair or replace sod only on City
owned right-of-way that is removed as the result of plowing activities.
VIII LAWN SPRINKLING AND LIGHTING SYSTEMS
The City will assume no responsibility for damage to exterior lighting systems and similar
landscaping installed in City owned right-of-way. The City will reimburse the property
owner $35 per sprinkler head for damage to underground sprinkling systems resulting
from direct contact with City snow removal equipment.
IX SNOW STORAGE
Ongoing snow and ice control efforts require the use of City owned right-of-ways and
easements for storage of plowed snow. Depending upon the volume of snow, storage
within right-of-way could create sight obstruction at intersections, because it is impossible
financially and practically to remove all snow from intersection corners.
X RESPONSIBILITY
The Superintendent of Streets and Fleet Publie AWfks and Street Supervisor with the
assistance of the Police Department, will monitor the street conditions to determine the
timing and number of crews and independent contractors necessary to clear the city
maintained public street system.
XI. UNUSUAL CIRCUMSTANCES
The City Manager or his or her designee is authorized to depart from this policy to settle
unusual claims when circumstances warrant, as determined by the City Manager. These
unusual situations shall be handled in a manner similar to the way other claims against the
City are handled.

PARKERS LAKE NORTH PICNIC SHELTER

The Parkers Lake North Picnic Shelter, located on the north side of County Road 6 at the
intersection with Shenandoah Lane, is operated by the City of Plymouth and may be rented by
Plymouth denz gretipseWfehbusinesses private groups, companies, civic
organizations, etc. Certain policies are needed to ensure the proper use and control of the facility
so that all people may equally enjoy it. The shelter is available to rent seven days a week(pending
on availability), from May 1 -September 30.
All individuals and/or businesses must complete a rental application and have it approved before
using the picnic shelter. Applications must be submitted and rentals must be paid in fill within
week of at least 14 days prior to the reservation. A rental will not be confirmed until the fees are
paid.
The shelter contains 11-12 picnic tables, four electrical outlets, two barbecue grills, fireplace and
bathrooms. The light switch for bathrooms is located in the janitor's closet on the west side of
the shelter, which can be opened with the bathroom key. Limited parking is available adjacent to
the shelter, with overflow parking down near the playflelds. There is also a small children's
playground located near the facility. See map on the back of this sheet.
It will be the responsibility of every group using the picnic shelter to dispose of all trash and do
some light clean-up of the facility. Recycling barrels are available for aluminum cans and plastic.
No glass beverage containers or alcohol, including beer, are permitted in Plymouth parks.
No person shall use tobacco products on City -owned property, park facilities, open space, or joint
City/School District properties, except within the confines of a vehicle in a designated parking
area.
The City will not be held liable for loss, damage, injury or illness incurred by the users for the
facility.
There are three time periods to choose from when renting the picnic shelter:
• 10 a.m. to 4 p.m. (half-day rental)
• 4:30 p.m. to 10:30 p.m. (half-day rental)
• 10 a.m. to 10 p.m. (ftill-day rental)
Rental fees are established by Chapter X of the Plymouth City Code.
The shelter closes at 10:30 p.m. There is a $100 key deposit (for the bathrooms) payable when
you pick up the key during office hours. Recreation office hours are: Monday, Wednesday,
Thursday, Friday, 8 a.m.-4:30 p.m. & Tuesdays, 8 a.m.-6 p.m.
Cancellation Policy: To cancel a rental, you must contact the Recreation Office at least 24 hatifs
two business days before your rental in order to receive a refund. For weekend use, you must
cancel by 4:30 p.m. on Thursday by calling 763-509-5200. If your event was canceled due to
inclement weather, you need to contact the recreation Office the next business day in order to
receive a refund. For all cancellations, a $5 fee will be retained from your rental fee.

I. OBJECTIVE
The objective of the City of Plymouth local government access channel 37 is to provide
local government meeting coverage and information on municipal services, events and

II. PROGRAM CONTENT
The f llo ing will apply to Pfagf m Programs permitted on the Plymouth government
access ref cable channel include:
Programs created by the city and involving local government matters such as but
not limited to ordinances, budgetary matters, capital improvements, service
enhancements or cutbacks, information about opportunities for community
residents and businesses to become involved in the local governmental process,
activities sponsored by the city, development within the city and other generic
local government information.
2. Organized debates or discussions between registered candidates for public office
including some portion of the City of Plymouth. Such debates/discussions shall
be sponsored by a non-partisan, nonprofit group such as the League of Women
Voters_ and produced by Northwest Communitv Television's professional
roduction staff,
B. Prohibited Programming Content
1. Non — City government — produced and/ or related content.
2. Programs associated in any way with gambling, obscenities, religious messages or
solicitations or advertisements.
3. Any political message by candidates.

IV. USE OF CITY OF PLYMOUTH CABLE TELEVISION EQUIPMENT
Use of cable television equipment owned by the city will conform to the following criteria:
A. City cable television equipment may be used only by City staff or Northwest
Community Television professional staff to fef the ptifpese a produce local

B. In addition to City Staff, City video equipment may be used by Northwest Community
Television's professional staff to videotape local origination programming that will air
on Northwest Community Television -operated channels and/or the City of Plymouth's
cable channel. City of Plymouth programming shall take precedence over local
origination programming requested by Northwest Community Television.

The City Manager or her/his designee is responsible for the implementation of this policy
and p ,,, edtifes including program content, programming, and use age of City cable
television equipment. The City Manager shall be the final arbitrator of matters of
interpretation with respect to this policy, especially regarding program content and channel
programming matters.
VI. AMENDMENT
The City may revise this policy periodically in response to changing needs or
circumstances affecting the operation of City of Plymouth local government access
channel -3-7.
