RESOLUTION 2007-312
APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT FOR AN
ACCESSORY CLUBHOUSE BUILDING FOR PARK PLACE APARTMENTS LOCATED
AT 14300 34TH AVENUE NORTH (2007045)
WHEREAS, Cluts O'Brien Strother Architects is requesting approval of a site plan amendment
and conditional use permit to allow a clubhouse building for property legally described as:
Lots 1, 2, 3, Block 1, and Lot 1, Block 2, Park Place, according to the recorded plat thereof,
Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Cluts
O'Brien Strother Architects for a site plan amendment and conditional use permit for property
located at 14300 34"' Avenue North, subject to the following conditions:
1. A site plan amendment and conditional use permit are approved for an accessory clubhouse
building for Park Place Apartments, in accordance with the application and materials received
by the City on May 3, 2007 and revised plans received on July 3, 2007 except as amended by
this resolution.
2. The conditional use permit to allow a 22 -foot high accessory building is approved with the
finding that the proposed use meets the applicable general conditional use permit standards, as
follows:
a) The property is guided Living Area 4 and an accessory clubhouse is an allowable use in
the Multiple Family 4 district. The accessory clubhouse would be consistent with the
comprehensive plan.

b) Approval of the conditional use permit would not be detrimental to the public health,
safety, morals or comfort.
c) The proposed use would not be injurious to the immediately surrounding properties. The
building would be set back roughly 400 feet from the nearest property and roughly 70
feet from the nearest apartment building. The applicant has designed the building to
complement the existing apartment buildings and the clubhouse would not exceed the
height of the adjacent apartment buildings.
d) The surrounding properties are fiilly developed and constriction of an accessory
clubhouse on this 35.5 acre site would not impede improvement of the surrounding
properties.
e) The subject site is adequately served by public facilities.
f) The proposed site plan and use would be consistent with all regulations and standards in
the RMF -4 zoning district. With the conditions in the attached resolution, the proposal
meets all requirements of the ordinance.
3. A separate building permit is required prior to any construction.
4. Prior to issuance of a building permit, the applicant shall complete the following:
a. Submit a site improvement performance agreement and financial guarantee pursuant to
Section 21045.10 of the Zoning Ordinance.
b. Revise the lighting plan in conformance with Section 21105.06 of the Zoning Ordinance.
c. Revise the survey to remove the two six-foot drainage and utility easements along the
private sanitary sewer line located north of the existing pool and tennis court.
d. Provide a rain garden maintenance agreement.
e. Receive approval of the necessary permits from the MPCA for sanitary sewer, Minnesota
Department of Health for watermain, Bassett Creek Water Management Commission, and
the NPDES.
f. The minimum elevation where storm water could enter the building (door or window)
shall be 18 inches above the emergency overflow elevation. It appears that the first floor
elevation of 970.0 for the clubhouse is too low. Revise plans to accommodate the 18 inch
freeboard requirement or add a storm sewer inlet for the northwest corner of the
clubhouse and demonstrate that roof and surface drainage will not become a flooding
issue.
g. Add a note to the utility plan to core drill all new connections to the sanitary sewer.
h. Indicate the size of pipe for the sanitary sewer on the utility plan.
i. Revise the utility plan to show the two existing storm sewer catch basins in the southeast
drive aisle as being connected.
j. Provide the Neenah casting number for the storm sewer covers that is consistent with the
City of Plymouth's Engineering Guidelines.
k. Identify the locations for storm sewer inlet protection on the plan.
1. Remove City detail ST -21 for the typical rain garden from the utility plan.
m. On page C-5.01 remove note N. e.

n. Reference the normal and high water elevation of the rain garden on the grading plan.
Add a note to reference the landscaping plan for the rain garden planting schedule.
o. Identify location of the rock constriction entrance, and include City detail ST -26.
p. Include the City's specifications for sanitary sewer, storm sewer, watermain, and street
constriction with the contract documents.
q. Remove the note on the utility plan referencing the need to vacate the drainage and utility
easement.
r. Relocate the fire department connection to an approved location at the main entry door to
the building.
s. Approved "EXIT" signs are required on all gates in the fencing around the pool.
t. Fire lane signs are required in approved locations.
u. The entire building must be protected by a City approved fire sprinkler system.
v. An approved fire department lock box is required at the main entry door to the building.
5. The brick, siding, and asphalt shingles shall match the adjacent apartment buildings.
6. All rooftop equipment shall be painted or screened to match the building.
7. Any signage shall require separate permits and shall comply with Section 21155 of the Zoning
Ordinance.
8. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof
shall be grounds for revocation.
9. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
10. This approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance.
