HomeMy WebLinkAboutCity Council Resolution 2007-311CITY OF PLYMOUTH RESOLUTION 2007-311 APPROVING A SITE PLAN AMENDMENT FOR OPUS NORTHWEST LLC, FOR AGA MEDICAL CORPORATION LOCATED AT 5050 NATHAN LANE (2007047) WHEREAS, Opus Northwest LLC, has requested approval of a site plan amendment for AGA Medical Corporation, located on property legally described as follows: Lot 1, Block 1, and Outlot A, Northwestern Bell Plymouth Office I" Addition, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Opus Northwest LLC, for a site plan amendment for property located at 5050 Nathan Lane, subject to the following conditions: 1. A site plan amendment to allow for the constriction of a 98 -stall surface parking lot on the north side of the building is hereby approved, in accordance with the plans received by the City on May 8, 2007, and additional information on June 28, 2007, except as may be amended by this resolution. 2. The applicant shall obtain the appropriate grading permit from the Building Division prior to commencement of the project. 3. Prior to issuance of the 2radin2 permit, the applicant shall: a. Submit the required Site Performance Improvement Agreement and related financial guarantee. b. Submit a revised lighting plan in accordance with Section 21105.06 of the Zoning Ordinance, including additional fixture details. Resolution 2007-311 (2007047) Page 2 c. Obtain the appropriate permits or approvals from Shingle Creels Watershed, Wetland Conservation Act and NPDES. 4. Prior to issuance of the 2radin2 permit, the applicant shall address the following Engineering Division related requirements: a. Provide an unobstructed access easement 15 feet wide (including a 12 foot wide driving surface) to the pond inlet and outlet. The access must originate from a public road, and cannot exceed a 3 % horizontal grade or a 10 % vertical grade. The access easement is required for any portion that falls outside of a public street right-of-way, or drainage and utility easement. Show the access route on the plan. b. Provide a drainage and utility easement for the proposed water quality pond, and the delineated wetland up to the 100 year high water level. c. Provide updated City standard details dated March, 2007. d. A wetland delineation report and site inspection are required. e. Show the efficiency removal for total suspended solids and phosphorus for the two cell pond. It must meet N[_7RP standards. f. On page C 1.2A the normal water elevation for pond cell number 2 shows 892.0. Correct this elevation to be 894.0. g. On page C1.7 revise castings R-1706-1 to R- 1642B in the Manhole / Casting Schedule. h. Show the length of pipe and invert elevation for the outlet from pond cell number 2, to manhole number 5. Also show the length of pipe and percent of grade from catch basin 1 to catch basin 2, and from catch basin 2 to catch basin 3. i. Add a note to tie all pipe joints in the twin cell pond. j. Add a note to sweep 51't Avenue on a weekly basis. k. Add a note on the utility plan to core drill the existing storm manhole in State Highway 169 Frontage Road. 1. Identify all unnecessary existing storm sewer pipe and structures in and southeast of the proposed parking lot as being removed. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 6. Prior to the financial guarantee being released, the City requires reproducible mylar prints of sanitary sewer, water service, storm sewer and pond As-Builts for the site. 7. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 8. This site plan amendment approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
