HomeMy WebLinkAboutCity Council Resolution 2007-300CITY OF PLYMOUTH RESOLUTION 2007-300 APPROVING A SITE PLAN, CONDITIONAL USE PERMITS AND VARIANCES TO ALLOW CONSTRUCTION OF A 1,477 SQUARE FOOT OFFICE BUILDING AND RELATED IMPROVEMENTS AT 13011 STATE HIGHWAY 55 AND 2320 XENl[_ M LANE (2007039) WHEREAS, GreenbergFarrow has requested approval of a site plan, conditional use permits and variances to allow constriction of an office building and related improvements, for property legally described as: Tract A: That part of the North Half of the Northeast Quarter of Section 27, Township 118, Range 22, Hennepin County, Minnesota, lying Easterly of a line 695.89 feet East of and parallel with the Northerly extension of the West line of Block 1, Minneapolis Industrial Park, according to the recorded plat thereof, and which lies North of a line 699.71 feet North of and parallel with the South line of said Block 1 and which lies South of a line 300.50 feet South of and parallel with the North line of said North Half of Northeast Quarter and which lies Southwesterly of the Southwesterly line of Sate Highway No. 55, except that part described as follows: Beginning at the intersection of the Easterly extension of the North line of Lot 1 of said Block 1 with the Northwesterly extension of the Northeasterly line of said Lot 1; thence Northwesterly along the Northwesterly extension of the Northeasterly line of said Lot 1 a distance of 111.35 feet; thence South 61 degrees 20 minutes 05 seconds West 150.00 feet; thence North 28 degrees 39 minutes 55 seconds West and parallel with the Southwesterly line of State Highway No. 55 a distance of 218.42 feet to the intersection with a line 699.71 feet North of and parallel with the South line of said Block 1; thence continue North 28 degrees 39 minutes 55 seconds West 11.58 feet; thence North 61 degrees 20 minutes 05 seconds East 150.00 feet to the Southwesterly line of State Highway No. 55; thence Southeasterly to the point of beginning. For description purposes the South line of said Block 1 bears North 88 degrees 43 minutes 40 seconds East. According to the United State Government Survey thereof, Hennepin County, Minnesota and together with the non-exclusive appurtenant easements contained in Document Nos. Resolution 2007-300 File No. 2007039 Page 2 4023393 and 4485713 recorded in the office of the County Recorder, Hennepin County, Minnesota. Tract B: That part of the North '/z of the Northeast'/4 of Section 27, Township 118, Range 22 described as follows: commencing at the intersection of the Southwesterly right of way line of the new State Trunk Highway No. 55 and the South line of the North '/z of the Northeast'/4 of said Section 27; thence Northwesterly along said right of way line a distance of 111.35 feet to the actual point of beginning of the land to be described; thence continuing Northwesterly along said Southwesterly right of way line a distance of 230 feet; thence at an angle of 90 degrees left a distance of 150 feet; thence at an angle of 90 degrees left a distance of 230 feet thence at an angle of 90 degrees left a distance of 150 feet to the actual point of beginning, according to the United States Government Survey thereof, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by GreenbergFarrow for a site plan, conditional use permits and variances for an office building and related improvements for the Public Storage property located at 13011 Highway 55 and 2320 Xenium Lane, subject to the following findings and conditions: 1. A site plan amendment is approved to allow constriction of a 1,477 square foot office building and related improvements, in accordance with the application materials received by the City on April 19, 2007 and May 23, 2007, except as amended by this resolution. 2. Conditional use permits are approved to allow 1) to constrict a building with 51.2 percent office in the I-2 district, where 50 percent is allowed as a permitted use, 2) to rent two moving tricks as an accessory use to the self -storage facility in the I-2 district, and 3) to use 24.7 percent of the office building for display and retail sale of boxes and other moving supplies, based on the finding that the standards listed in the Zoning Ordinance have been met, subject to the conditions listed in this resolution. 3. Variances are approved to allow redevelopment of a lot that is non -conforming due to lot area and to add a new drive aisle adjacent to an existing building, finding that the standards listed in the Zoning Ordinance have been met, subject to the conditions listed in this resolution. 4. A building permit is required prior to construction of any improvements related to the rp olect. Resolution 2007-300 File No. 2007039 Page 3 5. Prior to issuance of a building permit, the following information shall be submitted and/or plans shall be revised to meet the requirements of the Zoning Ordinance and engineering guidelines, as follows: a. Execute a site improvement performance agreement and submit the required financial guarantees pursuant to Section 21045.10 of the Zoning Ordinance. b. Revise the lighting plan to be consistent with the requirements of Section 21105.06. c. Revise the site plan to indicate bollards installed to protect the existing hydrant near the northwest corner of the property. d. Revise the plans to indicate that the new building will have a roof color consistent with the roof color of the existing self -storage buildings and the stucco portion of the new building shall be painted to be consistent with the existing buildings. e. Submit the following easements to allow improvements across a property line: 1) a cross access easement for emergency vehicles and customer vehicles and 2) a cross access and water supply easement for the watermain that crosses the property line between the two properties. f. Execute a rain garden maintenance agreement. g. Revise the landscaping plan to 1) relocate plantings shown in the emergency overflow route near the rain garden and 2) relocate four of the shrubs away from the storm sewer manhole and increase the landscaping proposed to provide screening for the trick rental storage space from Highway 55 consistent with the Zoning Ordinance. h. Submit revised turning radius evaluations for the new drive aisles from Highway 55 to the intersection with the existing northeast drive aisle to the Xenium Lane site entrance. Turning radius evaluations must include no contact with buildings, curbs or parking spaces. i. Identify the required 18 inches of freeboard from the lowest opening where storm water can enter the building (door or window) above the overland emergency overflow elevation. Adjust the building or driveway to meet this requirement as may be necessary. j. Identify the size and location of fire watermains from Xenium Lane to the newly relocated fire hydrant at the security gate. k. Submit a detail of the address directional signage that is required in approved locations at the Highway 55 and Xenium Lane site entrances. 1. Submit proof of permit issuance from the Mn/DOT, the Minnesota Department of Health and the Bassett Creek Watershed District. m. Submit $2,784.75 in water main area charges. n. Indicate the existing sanitary sewer service and well on the plans. o. Revise the plans to indicate the sanitary sewer connection from the existing service or indicate why this location is not proposed. Should the existing sanitary sewer service not be used, it must be abandoned to the property line and capped. Should the new service be connected to the manhole, demonstrate how the service will be installed adjacent to the existing utility pole. p. Revise the "Typical Emergency Overflow Ditch Section" and make it site specific to accommodate the combined flows for the 100 -year stormwater runoff event from the adjacent property's (Daimler Chrysler) N[_]RP pond, as well as the 50 -year runoff event Resolution 2007-300 File No. 2007039 Page 4 for the proposed ditch section located north and east of Chrysler's parking lot. Also, provide freeboard elevations in the cross section for the combined high water flow conditions. 6. Other Conditions: a. The rental tricks approved by this resolution shall not be stored on the .79 acre site. b. No outside repair or maintenance of the rental vehicles is to occur nor any outside storage of parts, equipment or damaged rental vehicles. c. A deceleration lane constricted to Mn/DOT's standards is required. d. All signage shall comply with the Section 21155 of the Zoning Ordinance. e. Access to fire lanes and hydrants is required to be maintained during demolition and throughout the constriction of the project. f. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. g. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 21030.06 and 21045.09, of the Zoning Ordinance.
