HomeMy WebLinkAboutCity Council Resolution 2007-299CITY OF PLYMOUTH RESOLUTION 2007-299 APPROVING A PUD (PLANNED UNIT DEVELOPMENT) GENERAL PLAN AMENDMENT FOR FINN DANIELS ARCHITECTS FOR PROPERTY LOCATED NORTH OF HIGHWAY 55, EAST OF SOUTH SHORE DRIVE AND WEST OF REVERE LANE (2006111) WHEREAS, Finn Daniels Architects has requested approval of a PUD Amendment for property currently legally described as follows: Outlots A, B, and C, The Village at Bassett Creek, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Finn Daniels Architects for a PUD General Plan Amendment, subject to the following conditions: 1. A PUD General Plan Amendment is approved for a five -story, 150,000 square foot office building for property located north of Highway 55, east of South Shore Drive and west of Revere Lane, in accordance with the plans received by the City on May 22, 2007, except as may be amended by this resolution. 2. Development standards shall be as indicated on the plans received by the City on May 22, 2007, except as may be amended by this resolution. 3. Compliance with the City's wetland buffer regulations. 4. Signage for the subject commercial office parcel shall be allowed pursuant to the same regulations applied to the 0 (Office) district, as specified by the Zoning Ordinance. The developer shall obtain the appropriate permits or approvals from Mn/DOT for access closure, Bassett Creels Water Management Commission, Department of Natural Resources for possible dewatering, MPCA for sanitary sewer extension, removal of asbestos -containing materials, hazardous soil removal, and possible removal of contaminated groundwater, Minnesota Department of Health for watermains, Wetland Conservation Act, Army Corps of Engineers, and NPDES. 6. The developer shall notify the Bassett Creels Water Management Commission of on-site asbestos -containing materials and of any contaminated groundwater. 7. Trash and recycling storage areas shall be maintained internal to the building. 8. Any visible rooftop or ground -mounted mechanical equipment shall be screened, painted, or treated to match the building. Materials for any screening walls shall be of the same materials as the principal stricture. 9. Prior to issuance of building permits, the developer shall: a. record the final plat with Hennepin County; b. obtain PUD final plan approval from the City of Plymouth; C. pay the park dedication cash fee in lieu of land dedication, in accordance with the dedication ordinance in effect at the time of issuance of the building permit; d. remove the existing outdoor advertising display (billboard) located in the southwest corner of the parcel; and e. provide evidence that a permanent conservation easement has been placed over the northern undeveloped portion of the site. 10. Prior to issuance of building permits, the applicant shall address the following Engineering Division related requirements: a. Provide required payment of the watermain area charges ($30,561.75) and sanitary sewer area charges ($8,236.50). b. The westbound off -ramp (slip -ramp) from State Highway 55 to Rowland Street shall be eliminated. The demolition and restoration plans for this work must be submitted to the Minnesota Department of Transportation (Mn/DOT) for review and approval. An approval letter from Mn/DOT is required. C. A ten -foot drainage and utility easement is required along all public streets. A six-foot drainage and utility easement is required along side and rear property lines. Revise the plat accordingly. d. A 20 -foot drainage and utility easement is required for public City utilities that are not located in a public street right-of-way. The watermain loop from Roland Street to 6th Resolution 2007-299 (2006111) PUD Amendment Page 3 of 6 Avenue shall be public. Indicate the 20 -foot easement on the plat. Indicate the 20 -foot storm sewer easement on the plat (that part which is not located in street right-of-way) for the pipe that nuns south and north of street A. e. Drainage and utility easements are required up to the 100 -year high water elevation for all ponds and wetlands, including the existing pond along the east property line between Highway 55 and 6"' Avenue. Add these easements to the plat. A separate 15 -foot wide unobstructed maintenance easement for access purposes is required to the inlet and outlet for the N [_]RP ponds. The vertical grade shall not exceed 15 percent and must originate from a public street. f. Submit a description of how increased volumes of runoff due to development would be minimized by limiting impervious cover and encouraging infiltration of storm water where soil conditions are appropriate. Revise the grading plan accordingly. g. Submit a description of how alternative landscape techniques and materials would reduce rates and volumes of runoff. Revise the grading plan accordingly. h. Submit a description of how this development would identify all reasonable steps to avoid water quality impacts and mitigate with appropriate best management practices (BMPs), to prevent water quality in receiving waters from falling below established standards. Revise the grading plan accordingly. i. An encroachment agreement is required for that portion of the parking lot which falls in the right -of way of Gaylord Avenue. j. Provide current City details from the Engineering Guidelines dated March, 2007. k. Include the City of Plymouth's Standard Specifications in the contract documents. 1. The curb and gutter in the parking lot and public streets (except two islands) shall be B612. M. It shall be written into the contract documents that the developer is responsible for the landscaping in the two islands in the public street. n. The minimum pavement width in the cul-de-sac, as measured from the outside edge of the turn -around to the island, is 28 feet. o. The watermain shall be PVC C900 DR18. Revise the plans to reflect this requirement. p. Additional watermain gate valves shall be installed in the following locations: 1) west of the existing 8 -inch stub at the intersection of 8t1' Avenue and 6t1' Avenue, and 2) east of the existing 8 -inch stub in Rowland Street. Revise the note on the utility plan to read "connect to existing 8 -inch CIP stub with 8 -inch gate valve then pipe". q. The utility plans submitted with the final plat shall include the sanitary sewer and watermain plan and profile, and the street and storm sewer plan and profile. r. The existing storm sewer pipes under State Highway 55 located east of the east plat line drain northerly. Both off-site and on-site drainage impacts must be included in the drainage calculations, and noted on the grading plan. S. The southeasterly wetland must have a boundary determination. t. Provide City detail ST -13 for the wetland mitigation detail. All mitigated wetlands must conform to this detail. Resolution 2007-299 (2006111) PUD Amendment Page 4 of 6 U. Provide one additional Best Management Practice (BMP) per the approved list for post constriction storm water control. V. It appears that storm water is trapped inside the 892 contour on the west side of the plat, as well as a small low area at the northwest corner of the plat. Drainage must be provided for those areas. W. Show wetland buffer post locations and include City detail ST -27. X. Change the abbreviation "OLE" to "NWL" to indicate the normal water elevation of all ponds, wetlands and mitigation areas. y. Clearly identify all overland emergency overflow (EOF) routes and elevations. Include the building and parking lot EOF routes. There must be a minimum of 18 inches of freeboard between the lowest building opening where storm water can enter and the EOF elevation. Z. Extend the location of the silt fence on the north side of the project. Show silt fence between the mitigation area and the stockpile location and on the south side of N [_]RP pond number 1. aa. Identify the locations of storm sewer inlet protection per City details ST -22 & 23. Remove details from page C3.3 that are not City of Plymouth approved. bb. Show the location for the rock constriction entrance. cc. Confirm under Note 4 on page C3.2 if the Mn/DOT seed mix 328 is new. dd. Add a note to the utility plan to tie the last 6 joints of all storm sewer pipes (and indicate the locations) on all inlet and outlet pipes. ee. Add a note to the utility plan that all storm sewer pipe and strictures that are 48 inches or less below finished grade shall have granular material placed to a depth of at least 48 inches. ff. Back fall from storm sewer manhole (STMH) 113 to the southerly fixed end section (FES) is not allowed. Provide positive grade from FES to STMH 113. gg. The minimum street grade is 0.75%. Revise the grade adjacent to street A from 0.5% to 0.75%. hh. Provide a storm sewer casting stricture schedule to include basin number, diameter, casting number, invert and rim elevations. ii. The proposed sanitary sewer extension in 6t1' Avenue is shallow and must be insulated. jj. There is only 0.62 feet of clearance between the sanitary and storm sewer cross in the island of 6t1' Avenue. Six inches of insulation are required. kk. The Wetland Replacement Plan application is not approved at this time. The final plat must be consistent with the approved wetland replacement plan. ll. Make the following modifications to the drainage calculations: 1) use hydrologic soil group C (HSGC); curve number (CN) shall reflect HSGC; 2) Type II 24-hour rainfall shall be the same for both pre- and post -models; 3) show total suspended solids (TSS) and phosphorus removal for pre- and post -constriction to demonstrate that N[_]RP ponds and the entire site meets N [_]RP requirements; and 4) resubmit with changes. mm. Identify the easterly N [_]RP pond EOF location and elevation. Resolution 2007-299 (2006111) PUD Amendment Page 5 of 6 nn. Indicate if the existing 24 -inch high density polyethylene (HDPE) in the easterly N [_]RP pond will be removed. oo. Identify the existing wetland mitigation boundary adjacent to the easterly N[_]RP pond. Identify whether this mitigation area been accounted for in the large mitigation area in Outlot A. pp. Provide a storm water pollution prevention plan (SWPPP). qq. One street light is required at the throat of each cul-de-sac. rr. Gaylord Avenue will not be vacated. Remove the note from the plat that indicates that it will be vacated. ss. Show the top and bottom elevation at various locations of the proposed retaining wall. If the wall exceeds four feet in height it must be designed by a licensed engineer, and a separate retaining wall permit is required from the Building Department. 11. Prior to issuance of building permits, the applicant shall address the following Fire Division related requirements: a. Relocate hydrants to approved locations. b. Identify the PIV and Fire Dept. connection locations. C. Submit turning radius evaluations for all Fire Dept. vehicles from the cul-de-sacs to the drive aisles on the north and east sides of the building. d. The entire building must be protected by a City -approved fire sprinkler system. e. Fire lane signs must be indicated on the plans in locations approved by the Fire Inspector. 12. Prior to issuance of the certificate of occupancy, a Transportation Demand Management (TDM) Program shall be submitted for staff review and approval. 13. In addition to the two access points shown on plan received on May 22, 2007, a private driveway shall be installed to provide access through the northwestern portion of the site to connect the parking lot to 1011 Avenue. The private driveway shall be installed in accordance with City standards and in a manner that minimizes tree loss. 14. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. A reproducible 8 '/z x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees. C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
