HomeMy WebLinkAboutCity Council Resolution 2007-288CITY OF PLYMOUTH RESOLUTION 2007-288 APPROVING A CONDITIONAL USE PERMIT FOR VLADIMIR AND ANDREA KELMAN TO ALLOW AN ATTACHED GARAGE CONTAINING OVER 1,000 SQUARE FEET FOR PROPERTY LOCATED AT 1010 GARLAND LANE NORTH (2007040) WHEREAS, Vladimir and Andrea Kelman have requested a conditional use permit to allow an attached garage containing 1,904 square feet in gross floor area on property legally described as follows: Lot 4, Block 3, City View Acres 2"a Unit, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Vladimir and Andrea Kelman for a conditional use permit, subject to the following conditions: 1. The conditional use permit allows an attached garage containing 1,904 square feet in gross floor area, as shown on the application and plans received by the City on April 20, 2007, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. 3. The total impervious surface coverage for this lot shall not exceed 25 percent, in compliance with the shoreland overlay district regulations for Pomerleau Lake. Resolution 2007-288 (2007040) Page 2 of 2 4. Prior to installing a 2arne door on the lower level, the applicant must alter the plans submitted for the initial building permit. The plans submitted must show the lower level door consistent with the photo submitted on June 19, 2007. 5. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
