HomeMy WebLinkAboutCity Council Resolution 2007-264CITY OF PLYMOUTH RESOLUTION 2007-264 APPROVING ENCROACHMENT AGREEMENT FOR A RETAINING WALL LOCATED AT 2385 WEST MEDICINE LAKE DR. LOTS 25 & 26, BLOCK 1, ELMHURST WHEREAS, Daniel and Mary Balloy have requested approval to execute an encroachment agreement to constrict a modular retaining wall within the existing public drainage and utility easement; and; WHEREAS, the encroachment agreement only permits the encroachment of the retaining wall within the easement and all related facilities must still meet all applicable City codes; and WHEREAS, the property is legally described as Lots 25 and 26, Block 1, Elmhurst; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth an encroachment agreement that will allow for the modular retaining wall to encroach within the public drainage and utility easement. Adopted by the City Council on June 12, 2007. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
