HomeMy WebLinkAboutCity Council Resolution 2007-261CITY OF PLYMOUTH RESOLUTION 2007-261 APPROVING ENCROACHMENT AGREEMENT FOR A WOOD DECK LOCATED AT 11615 40TH AVENUE LOT 1, BLOCK 3, MISSION TRAILS WHEREAS, Mr. James Devine has requested approval to execute an encroachment agreement to constrict a wood deck within the existing public drainage and utility easement; and; WHEREAS, the encroachment agreement only permits the encroachment of the wood deck within the easement and all related facilities must still meet all applicable City codes; and WHEREAS, the property is legally described as Lot 1, Block 3, Mission Trails; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on behalf of the City of Plymouth an encroachment agreement that will allow for a wood deck and the associated footings to encroach within the public drainage and utility easement. Adopted by the City Council on June 12, 2007. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on June 12, 2007, with the original thereof on file in my office, and the same is a correct transcription thereof.
