HomeMy WebLinkAboutCity Council Resolution 2007-249CITY OF PLYMOUTH RESOLUTION 2007-249 APPROVING A FINAL PLAT FOR "FRETHAM SIXTH ADDITION" FOR TWO SINGLE- FAMILY LOTS FOR PROPERTY LOCATED AT 1900 EAST MEDICINE LAKE BOULEVARD (2006121-F) WHEREAS, Lake West Development Co., LLC, has requested approval of a final plat to allow a subdivision of two single-family lots on the 36,858 square foot site presently addressed as 1900 East Medicine Lake Boulevard; and WHEREAS, the property is legally described as follows: Lots 16 and 17, Block 16, Medicine Lake Park Third Division, including adjacent one-half of vacated 19"' Avenue as vacated by Document No. 4557125, also including adjacent one-half of vacated Lancaster Lane as vacated by Document No. 4557126. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lake West Development Co., LLC, for a final plat for two single-family lots, for property located at 1900 East Medicine Lake Boulevard, subject to the following conditions: 1. The final plat is approved in accordance with the plans received by the City on June 4, 2007, except as may be amended by this Resolution. 2. The development shall comply with all standards specified for the RSF-2 (Single Family Detached 2) zoning district. No variances are granted or implied, except that a lot width variance was previously approved for each lot. 3. Because this site lies within the Shoreland District for Medicine Lake, each lot within the plat is limited to a maximum impervious surface coverage of 25 percent, or as may be amended in the fiiture. 4. The purchase agreements for each of the lots, as well as any marketing materials for this development, shall clearly state that the maximum impervious surface coverage, including swimming pools, shall be limited to 25 percent of the lot area. Appropriate permits and approvals shall be obtained from the Bassett Creels Water Management Commission, Minnesota Department of Health for capping existing wells (if applicable), and City of Plymouth (right-of-way). 6. Prior to recording the final plat, the developer shall revise the plans as follows or provide the following required information: a. A 10 -foot wide drainage and utility easement is required adjacent to all public roads. A 6 - foot wide drainage and utility easement is required along the side and rear property lines. b. A right -of -entry agreement is required form the property owner to the south in order to make the new service connections for Lot 2. c. A rain garden maintenance agreement is required. d. Adjust the pad elevations for Lots 1 and 2 demonstrating that there is a minimum of 18 inches of freeboard from the lowest building opening (door or window) to the overland overflow route. e. A planting schedule and design is required for the rain garden. Include type, size, and quantity of the plugs, or larger plantings, to be planted. Plugs or larger plantings are required to be 18 inches on center. f. Provide a cross-section view of the rain garden. Include the bottom elevation, Normal Water Level and High Water Level. g. Adjust the south edge of the retaining wall so it is located outside of the drainage and utility easement. h. Adjust the pad elevation of Lot 1 to provide a minimum drainage swale of 1.75% away from and around the pad. i. Add a note to install filter fabric under all riprap, and indicate locations on the plan. j. Move the proposed drainage swale south of Lancaster Lane easterly, so that it is located more in the center of the drainage and utility easement. Revise the grading plan to reflect this change. k. Reinforce the drainage route south of Lancaster Lane with a permanent turf reinforcement mat that is designed to withstand the expected flow velocities for the 100 -year rain event. Identify the type of mat and the location on the grading plan. 1. Add a note to the utility plan that Medicine Lake Boulevard shall have fiill street restoration with bituminous surface within 48 hours after making the service installation. in. Add a note to the utility plan that the contractor must contact the Plymouth Engineering Department two weeks in advance of posting the closure of Medicine Lake Boulevard. n. Identify the location of the curb stop (water shut off valve) on the utility plan. o. Revise the signature block for the City Engineer on the Mylar Plat copies to a standard signature block. Remove the note "This plat was recommended for approval this day of , 20." Resolution 2007-249 (2006121-F) Page 3 7. Prior to release of the final plat, the developer shall: a. Pay the park dedication fees in lieu of land dedication for two (2) dwelling units, pursuant to the Dedication Ordinance in effect at the time of recording the final plat. b. Remove all existing strictures from the site. 8. A 2radin2 permit is required prior to any excavation or trading on the site. Approval of the site grading and excavation for each lot may also be approved with a building permit issuance. Silt fence shall be installed on the property. 9. Prior to removal of any trees, the applicant shall install all tree protection fencing, submit a tree preservation financial guarantee, and have the site inspected by the City Forester. 10. Building permits shall be obtained prior to any constriction on the site. 11. No building permits shall be issued until: a. The final plat is filed and recorded with Hennepin County; and b. A Site Improvement Performance Agreement (SIPA) and all related financial guarantees are submitted. 12. The developer is encouraged to work with the adjacent homeowner at 1925 Kilmer Lane when designing and locating the new homes on the site, in order to maintain his partial view of Medicine Lake. 13. A dock shall be allowed for each lot in the area west of East Medicine Lake Boulevard pursuant to the dock agreement signed by the developer. The Mayor and Manager are hereby authorized to execute the dock agreement on the City's behalf. 14. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of the City Code. d. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
