HomeMy WebLinkAboutCity Council Resolution 2007-246CITY OF PLYMOUTH RESOLUTION 2007-246 APPROVING A SITE PLAN AND VARIANCE FOR JOHN DAY COMPANY FOR A BANK AT THE SOUTHEAST CORNER OF 37TH AVENUE AND VICKSBURG LANE (2007027) WHEREAS, John Day Company has requested approval of a site plan and variance to allow development of a bank on a roughly one -acre parcel presently legally described as Lot 2, Block 2, Plymouth Hills. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by John Day Company for a site plan and variance for property located at the southeast corner of 37th Avenue and Vicksburg Lane, subject to the following conditions: 1. Approval of the site plan and variance is contingent upon prior administrative approval of the requested minor subdivision, and compliance with all conditions thereto. 2. The requested site plan and variance are hereby approved, in accordance with the application and plans received by the City on March 15, 2007 together with revisions dated May 4, 2007, except as may be amended by this resolution. 3. The variance allows four vehicular stacking spaces per drive -up teller lane where six stacking spaces per lane are specified, based on the finding that the applicable variance standards have been met. 4. All signage shall comply with the sign regulations identified in Section 21155 of the Zoning Ordinance. 5. Prior to commencing any work on the site, the applicant must obtain the appropriate permits from the Building Division. Resolution 2007-246 (2007027) Page 2 6. Prior to issuance of building permits, the applicant shall: a. Provide the City with a recorded copy of the cross -access easement agreement for shared parking and access. b. Submit a cross access agreement for water supply and unobstructed access. c. Submit the required Financial Guarantee and Site Improvement Performance Agreement for completion of site improvements. d. Submit a maintenance agreement for the rain garden. e. Obtain all necessary permits and approvals including MPCA, State Health Department, Bassett Creek, and NPDES. f. Submit fire flow calculations for review by the Fire Inspector. 7. In conjunction with constriction of the bank on the roughly one -acre parcel at the corner, sidewalks shall be installed adjacent to Vicksburg Lane and 37th Avenue on the four -acre site presently legally described as Lot 2, Block 2, Plymouth Hills. 8. Any rooftop or ground mounted mechanical equipment shall be designed (including exterior color) and located so as to be aesthetically harmonious and compatible with the building. Rooftop equipment over three (3) feet above the parapet shall be screened with durable materials which are aesthetically compatible with the stricture. In no case shall wooden fencing be used as a rooftop equipment screen. 9. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 10. Standard Conditions: a. The applicant shall comply with the Ordinance regarding turning radii and location of fire lane signage. b. Prior to the release or reduction of any financial guarantees, the applicant shall submit a reproducible 8 '/z x I I inch "As -Built" Fire Protection Plan. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning Ordinance.
