HomeMy WebLinkAboutCity Council Resolution 2007-242CITY OF PLYMOUTH RESOLUTION 2007-242 DENYING A REQUEST FOR A PUD AMENDMENT TO REPLACE A CHANGEABLE COPY SIGN WITH AN ELECTRONIC CHANGEABLE COPY SIGN FOR HANS HAGEN HOMES AT PLYMOUTH STATION LOCATED AT 16605 COUNTY ROAD 24. (2007020) WHEREAS, Hans Hagen Homes has requested a Planned Unit Development Amendment to allow an electronic changeable copy sign with 77 percent of the total sign area where the Zoning Ordinance allows 25 percent in the Plymouth Station PUD on property legally described as follows: Lot 1, Block 1 PLYMOUTH STATION, according to the recorded plat thereof, except that part platted as Registered Land Survey No. 1776, according to the recorded plat thereof, all in Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Hans Hagen Homes for a PUD Amendment to replace a changeable copy sign with an electronic changeable copy sign at Plymouth Station, based on the following findings: 1. The subject property is guided C in the Comprehensive Plan and zoned PUD. 2. The Comprensive Plan states that traffic safety is an ongoing priority for the City and that the City will continue to pursue whatever avenues are available to provide a safe transportation system. 3. Section 21155.01 of the Zoning Ordinance states that the City finds that signs can create traffic hazards, aesthetic concerns and detriments to property values, thereby threatening the public health, safety and welfare. Section 21155.02 of the Zoning Ordinance states that the purpose and intent of this Section is to 1) regulate the size, type, illumination and other physical characteristics of signs in order to promote the public health, safety and welfare and 2) provide for fair and consistent enforcement of the sign regulations. 5. In 1998, a master sign plan was approved for Plymouth Station based on the finding that it accomplished communication goals while maintaining a high design standard and minimal negative impacts on the residential areas to the south. 6. Resolution 98-256 approved the master sign plan for the Plymouth Station PUD which stated that signs shall comply with Sectin 21155, unless specifically approved or restricted under the master sign plan. 7. Allowing an electronic sign to exceed the 25 percent limitation would be inconsistent with the findings and intent of the sign regulations to regulate signs in a manner that promotes the public health, safety and welfare of the community.
