RESOLUTION NO. 2007-201
AUTHORIZING THE VACATION OF
31sT AVENUE RIGHT-OF-WAY AS PLATTED IN
MAPLEDELL FIRST ADDITION
WHEREAS, a public hearing with respect to said vacation was scheduled for April 24, 2007 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of April 24, 2007; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on April 24, 2007 to inform any and all interested
parties relevant to the vacation of 31st Avenue right-of-way in Mapledell First Addition; and
WHEREAS, it was determined by the City Council that 31st Avenue right-of-way was not needed for
roadway purposes but the City will retain an easement for public and private utility purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following 31st Avenue right-of-way be vacated:
All that part of 31st Avenue right-of-way as platted within Mapledell First Addition
lying east of the northerly extension of the west line of Lot 6, Block 1, Mapledell First
Addition except that part of Black Oaks Lane right-of-way extended.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer
lines, water pipes, mains, hydrants, trail purposes and natural drainage areas thereon or thereunder, to
continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair,
replace, remove, or otherwise attend thereof.
