HomeMy WebLinkAboutCity Council Resolution 2007-199CITY OF PLYMOUTH RESOLUTION 2007-199 Approving the Application, Committing Local Match and Authorizing Contract Signatures for the Department of Employee and Economic Development's Contamination Cleanup Grant Program on Behalf of JNA 55, LLC. WIffiREAS, JNA 55, LLC is in the process of constricting Bassett Creels Office Centre, a 5 - story 150,000 square foot building located at the northwest quadrant of Highway 55 and Revere Lane; and WIffiREAS, as part of the environmental reviews for this project, it was determined that asbestos debris contamination exists on the site and the developer will be required to clean up the soil contamination within the boundaries of the property; and WIffiREAS the City of Plymouth has approved the Contamination Cleanup grant application submitted to the Department of Employee and Economic Development (DEED) on May 01, 2007, by JNA 55, LLC for the Bassett Creels Office Centre site; and WIffiREAS the City of Plymouth will act as the legal sponsor for project(s) contained in the Contamination Cleanup Grant Program to be submitted on May 01, 2007 and that the City Manager is hereby authorized to apply to the Department of Employment and Economic Development for fiinding of this project on behalf of the City of Plymouth; and BE IT RESOLVED that the City of Plymouth has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration; and BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the application are committed by JNA55, LLC to the project identified and will not come from the City of Plymouth; and BE IT FURTHER RESOLVED that the City of Plymouth has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice; and BE IT FURTHER RESOLVED that upon approval of its application by the state, the City of Plymouth may enter into an agreement with the State of Minnesota for the above -referenced project(s), and that the City of Plymouth certifies that it will comply with all applicable laws and regulations as stated in all contract agreements; and Resolution No. 2007-199 Page 2 of 2 NOW, THEREFORE BE IT RESOLVED that the Mayor and City Manager are hereby authorized to execute such agreements as are necessary to implement the project(s) on behalf of the applicant.
