RESOLUTION 2007-190
APPROVING ENCROACHMENT AGREEMENT FOR STRUCTURES
WITHIN THE FIELDS OF NANTERRE DEVELOPMENT
WHEREAS, Ryland Homes Inc. has agreed to an encroachment agreement to allow existing
retaining walls and sidewalks to occupy public drainage and utility easements as dedicated in The
Fields of Nanterre Additions; and
WHEREAS, the encroachment agreement only permits the encroachment and the retaining walls
and sidewalks and all related facilities must still meet all applicable City codes including the
building code and zoning code; and
WHEREAS, the properties to which this encroachment agreement is granted is legally described in
the encroachment agreement document; and
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for existing retaining
walls and sidewalks to occupy public drainage and utility easements.
