HomeMy WebLinkAboutCity Council Resolution 2007-177CITY OF PLYMOUTH RESOLUTION NO. 2007-177 AUTHORIZING CONDEMNATION PROCEEDINGS COUNTY ROAD 61/47 INTERSECTION IMPROVEMENT CITY PROJECT NO. 6108 WHEREAS, the City of Plymouth has undertaken the improvement project at the intersection of County Road Nos. 61 and 47, City Project No. 6108; and WHEREAS, the City Council has approved plans and specifications for City Project No. 6108 on March 27, 2007; and WHEREAS, in order to constrict the improvements, certain permanent and temporary easements are required; and WHEREAS, the City Council finds it necessary, proper, and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements over Lot 1, Block 1, Bass Lake Hills Addition; and WHEREAS, the City Council finds that the constriction schedule for said public project makes it necessary to acquire title to and possession of the easement interests prior to the filing of the final report of the condemnation commissioners to be appointed by the district court; and WHEREAS, the use of Minn. Stat. Sec. 117.042 (1988), so-called "Quick -Take" statute, will enable the City to timely acquire the required lands; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the City Attorney is hereby authorized to commence condemnation proceedings utilizing said "Quick -Take" statute for City Project No. 6108 for the following described easements within the following described parcels: DESCRIPTION OF PROPERTY: (PIN 3-118-22-14-0002) Lot 1, Block 1, BASS LAKE HILLS, according to the recorded plat thereof, Resolution No. 2007-176 Page 2 DESCRIPTION OF EASEMENT: A perpetual easement for street purposes over, under, across and through that part of said property as described below: Commencing at the most Easterly corner of said Lot 1, Block 1, Bass Lake Hills; thence Southwesterly along the Southeasterly line of said Lot 1, a distance of 52.00 feet to the actual point of beginning of said easement lying easterly and northeasterly of the following described line: Thence Northwesterly on a bearing of North 13 degrees 09 minutes 04 seconds West, a distance of 58.41 feet; thence Northwesterly a distance of 174.92 feet along a non-tangential curve concave to the Southwest, having a radius of 747.00 feet, a central angle of 13 degrees 24 minutes 58 seconds and the chord of said curve bears North 71 degrees 42 minutes 20 seconds West; thence North 18 degrees 17 minutes 40 seconds East, a distance of 5.00 feet to the northeasterly line of said Lot 1 and there terminating. Along with, An easement for temporary constriction purposes over, under and across that part of the following described property: That part of Lot 1, Block 1, BASS LAKE HILLS according to said plat on file and of record in the office of the County Recorder, Hennepin County, Minnesota lying to the right of the following described line: Commencing at the southeast corner of the Northeast Quarter of Section 3, Township 118 North, Range 22 West, Hennepin County, Minnesota, thence North 89 degrees 42 minutes 05 seconds West, assumed bearing, along the south line of said Northeast Quarter a distance of 1079.42 feet to the southeasterly line of said Lot 1; thence northeasterly a distance of 402.61 feet along the southeasterly line of said Lot 1 and along a non-tangential curve, concave to the southeast, having a radius of 2914.79 feet, a central angle of 7 degrees 54 minutes 51 seconds and a chord that bears North 29 degrees 33 minutes 58 seconds East to the point of beginning of the line to be described; thence North 56 degrees 25 minutes 21 seconds West along a non -tangent line a distance of 20.00 feet; thence northeasterly a distance of 192.24 feet along a non-tangential curve, concave to the southeast, having a radius of 2934.79 feet, a central angle of 3 degrees 45 minutes 11 seconds and a chord that bears North 35 degrees 24 minutes 01 seconds East; thence South 52 degrees 43 minutes 23 seconds East along a non -tangent line a distance of 8.00 feet; thence northeasterly a distance of 225.90 feet along a non-tangential curve, concave to the southeast, having a radius of 2926.79 feet, a central angle of 4 degrees 25 minutes 20 seconds and a chord that bears North 39 degrees 29 minutes 17 seconds East; thence North 48 degrees 18 minutes 03 seconds West along a non -tangent line a distance of 28.00 feet; thence northeasterly a distance of 173.27 feet along a non-tangential curve, concave to the southeast, having a radius of 2954.79 feet, a central angle of 3 degrees 21 minutes 35 seconds and a chord that bears North 43 degrees 22 minutes 45 seconds East; thence northwesterly a distance of 82.20 feet along a non-tangential curve, concave to the southwest, having a radius of 697.00 feet, a central angle of 6 degrees 45 minutes 27 seconds and a chord that bears North 69 degrees 02 minutes 23 seconds West; thence North 72 degrees 14 minutes 38 seconds West along a Resolution No. 2007-176 Page 3 non -tangent line a distance of 143.27 feet; thence North 05 degrees 58 minutes 24 seconds East a distance of 40.00 feet to the northerly line of said Lot 1 and said line there terminating. Said temporary easement will commence on June 1, 2007 and expire on December 31, 2008. Adopted by the City Council on April 24, 2007.
