HomeMy WebLinkAboutCity Council Resolution 2007-174CITY OF PLYMOUTH RESOLUTION 2007-174 APPROVING A CONDITIONAL USE PERMIT FOR JOHN STABY TO ALLOW AN ATTACHED GARAGE CONTAINING OVER 1,000 SQUARE FEET FOR PROPERTY LOCATED AT 5615 GLACIER LANE NORTH (2007015) WHEREAS, John Staby has requested a conditional use permit to allow an attached garage containing 2,134 square feet in gross floor area on property legally described as follows: Lot 22, Block 3, Glacier Vista, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by John Staby for a conditional use permit, subject to the following conditions: 1. The conditional use permit allows an attached garage containing 2,134 square feet in gross floor area, as shown on the application and plans received by the City on February 13, 2007 and March 6, 2007, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. 3. The total impervious surface coverage for this lot shall not exceed 25 percent, in compliance with the shoreland overlay district regulations for Pomerleau Lake. 4. Prior to any construction, the applicant must obtain separate approval of a building permit. Resolution 2007-174 (2007015) Page 2 of 2 5. Prior to issuance of a permit, the applicant shall submit a revised landscaping plan demonstrating compliance with the tree species and number of inches shown on the approved landscaping plan. 6. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b. The applicant shall install an automatic fire sprinkler system throughout the home. c. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. d. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
