RESOLUTION 2007-169
APPROVING A LAND USE GUIDE PLAN AMENDMENT FOR LCS DEVELOPMENT
FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION
OF COUNTY ROAD 47 AND FUTURE CHESHIRE LANE (2007013)
WHEREAS, LCS Development has requested reclassification of the land use guiding of 33.7
acres of the 46.36 -acre site located at the southwest corner of the intersection of County Road
47 and the extension of Cheshire Lane from LA -2 (Living Area 2) to Living Area 3 (Living Area
3 ); and,
WHEREAS, the property affected by the amendment is presently legally described as follows:
That part of Government Lot 1 and that part of the Southeast Quarter of the Northeast
Quarter both in Section 4, Township 118, Range 22, Hennepin County, Minnesota,
described as follows:
Beginning at the southwest corner of said Southeast Quarter of the Northeast Quarter;
thence South 00 degrees 08 minutes 03 seconds West, assumed bearing along the
westerly line of said Government Lot 1 a distance of 600.00 feet to the south line of the
North 600.00 feet of said Government Lot 1; thence South 89 degrees 42 minutes 28
seconds East, along said south line a distance of 1168.52 feet; thence North 00 degrees
00 minutes 08 seconds East, a distance of 348.74 feet; thence northwesterly along a non-
tangential curve concave to the southwest having a central angle of 53 degrees 54
minutes 26 seconds, a radius of 453.04 feet and an arc distance of 426.24 feet, the chord
of said curve bears North 27 degrees 17 minutes 27 seconds West; thence North 54
degrees 14 minutes 43 seconds West, not tangent to said curve a distance of 38.22 feet;
thence northerly along a tangential curve concave to the northeast having a central angle
of 43 degrees 21 minutes 17 seconds, a radius of 455.00 feet and an arc distance of
344.29 feet; thence North 10 degrees 53 minutes 26 seconds West, tangent to said curve
a distance of 186.71 feet; thence northerly along a tangential curve concave to the east
having a central angle of 19 degrees 32 minutes 03 seconds, a radius of 455.00 feet and
an arc distance of 155.13 feet; thence North 08 degrees 38 minutes 37 seconds East,
tangent to said curve a distance of 170.57 feet; thence northerly along a tangential curve
concave to the east having a central angle of 5 degrees 56 minutes 59 seconds, a radius of
1000.00 feet and an arc distance of 103.84 feet; thence northerly along a tangential
reverse curve concave to the west having a central angle of 23 degrees 32 minutes 23

seconds, a radius of 299.50 feet and an arc distance of 123.05 feet; thence North 08
degrees 56 minutes 47 seconds West, not tangent to said curve a distance of 46.60 feet to
the southerly right of way line of Hennepin County Highway No. 47; thence South 81
degrees 03 minutes 38 seconds West, along said southerly line a distance of 308.61 feet;
thence westerly along a tangential curve and along said southerly line concave to the
north having a central angle of 2 degrees 54 minutes 03 seconds, a radius of 991.18 feet
and an arc distance of 50.18 feet; thence North 00 degrees 18 minutes 55 seconds East,
not tangent to said curve a distance of 33.21 feet to the centerline of said Hennepin
County Highway No. 47; thence westerly along a non-tangential curve and along said
centerline concave to the north having a central angle of 11 degrees 22 minutes 53
seconds, a radius of 958.18 feet and an arc distance of 190.34 feet, the chord of said
curve bears South 89 degrees 25 minutes 55 seconds West; thence South 00 degrees 18
minutes 55 seconds West not tangent to said curve, a distance of 33.11 feet to said
southerly right of way line of Hennepin County Highway No. 47; thence westerly along a
non-tangential curve and along said southerly line, concave to the north having a central
angle of 2 degrees 36 minutes 24 seconds, a radius of 991.18 feet and an arc distance of
45.09 feet, the chord of said curve bears North 83 degrees 44 minutes 04 seconds West;
thence North 82 degrees 25 minutes 52 seconds West, along said southerly line and
tangent to said curve a distance of 179.59 feet to the west line of said Southeast Quarter
of the Northeast Quarter; thence South 00 degrees 18 minutes 55 seconds West along
said west line a distance of 1161.74 feet to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
LCS Development for reclassification of the land use guiding from LA -2 (Living Area 2) to LA -
3 (Living Area 3) for 33.7 acres of the 46.36 -acre parcel of land located at the southwest corner
of the intersection of County Road 47 and the fiiture extension of Cheshire Lane, based on the
following findings:
1. The LCS Development sketch for the "Trillium Woods" site meet the location criteria for
LA -2 and LA -3. However, greater flexibility in design is possible with the higher density and
wider variety of stricture types in LA -3. Consequently the LA -3 offers greater opportunity
to preserve the site's natural amenities as illustrated on the sketch.
2. The recently completed natural resources inventory identified a major stand of trees on the
west side of the property that should be preserved. This new information supports re-
evaluating the guiding of this site.
3. Reguiding 33.7 acres of this 46.36 -acre site would not adversely affect the LA -2 land supply.

4. LA -3 provides the opportunity for a greater range of lifestyle housing choices.
5. Developments proposed under either the LA -2 or the LA -3 would not result in negative
impacts on infrastructure, assuming constriction of the traffic improvements proposed in
conjunction with the development. These improvements would be required in conjunction
with any development, but would not likely occur as separate projects.
FURTHER, approval of the land use guide plan amendment is contingent upon, and subject to,
the required review and response by the Metropolitan Council.
