HomeMy WebLinkAboutCity Council Resolution 2007-167CITY OF PLYMOUTH RESOLUTION NO. 2007-167 ORDERING IMPROVEMENT FERNBROOK LANE 27TH AVENUE TO 34TH AVENUE CITY PROJECT NO. 1013 WHEREAS, the City Council adopted a resolution on the 27"' day of February, 2007, fixed a date for a public hearing with respect to the improvements to Fernbrook Lane, 27t1' Ave to 34"' Ave; and WHEREAS, the proposed project includes the addition of turn lanes at the intersections of 34"' Avenue, Harbor Lane, Highway 55 and 27"' Avenue along with revisions to the signal system at Highway 55, installation of permanent signal systems at Harbor Lane and 27t1' Avenue and all necessary appurtenances; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held thereon the 10"' day of April, 2007, at which time all persons desiring to be heard were given an opportunity to be heard thereon, and WHEREAS, ordering this improvement requires a 4/5 vote of the council (six votes) since the project has not been petitioned for by the benefiting property owners; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: Such improvement is necessary, cost-effective, and feasible as detailed in the Preliminary Engineering Report. 2. Such improvement is hereby ordered as proposed in the Council resolution adopted April 10, 2007. Adopted by the City Council on April 10, 2007.
