HomeMy WebLinkAboutCity Council Resolution 2007-150CITY OF PLYMOUTH RESOLUTION 2007-150 APPROVING A CONDITIONAL USE PERMIT TO ALLOW INSTALLATION OF A 75 -FOOT MONOPOLE WITH TELECOMM[_]NICATION ANTENNAS AND RELATED EQUIPMENT FOR T -MOBILE CENTRAL, LLC. AT 5450 NORTHWEST BOULEVARD (2007003) WHEREAS, T -Mobile Central, LLC. has requested approval of a conditional use permit for a 75 -foot monopole tower to be located on the following described property: Tract C, Registered Land Survey 41575 on file of record with the Registrar of Titles, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by T -Mobile Central, LLC. for a conditional use permit at 5450 Northwest Boulevard, subject to the following conditions: 1. A conditional use permit is approved to allow a 75 -foot high monopole tower with antennas and the related equipment, as shown on the application and plans received by the City on January 17, and February 2 and 20, 2007, except as may be amended by this resolution. 2. The project requires a separate building permit prior to installation of the tower and equipment. 3. Prior to issuance of a building permit, the applicant shall revise the plans to 1) specify the pole is to be painted to match the other light poles in the athletic field, and 2) locate the chain link fence on top of the retaining wall (for weed control) and the wooden fence the same distance from the retaining wall as the existing fence. Resolution 2007-150 (2007003) Page 2 4. All fencing shall conform to the requirements of the Zoning Ordinance. 5. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 6. The conditional use permit shall expire one year from the date of approval, unless the project is substantially completed or an extension is applied for and granted, as regulated under Sections 21015.07 of the Zoning Ordinance.
