HomeMy WebLinkAboutCity Council Resolution 2007-127CITY OF PLYMOUTH RESOLUTION 2007-127 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR U.S. HOME CORPORATION FOR "TARYN HILLS 6"' ADDITION" FOR PROPERTY LOCATED SOUTHEAST OF COUNTY ROAD 47 AND VICKSBURG LANE (2007019) WHEREAS, U.S. Home Corporation has requested approval of a final plat for 51 single-family lots on roughly 15 acres of land located southeast of County Road 47 and Vicksburg Lane in the "Taryn Hills" plat; and WHEREAS, the property is presently legally described as follows: Outlot A, Taryn Hills 4"' Addition, Hennepin County, Minnesota, according to the recorded plat thereof. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by U.S. Home Corporation for a final plat for Taryn Hills 6"' Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The plat is approved in accordance with the plans received by the City on February 22, 2007, except as may be amended by this resolution. Resolution 2007-127 File 2007019 Page 2 2. Development standards shall be as required by the RSF-3 district. No variances are granted or implied. 3. The developer must obtain a sign permit from the City Building Official prior to installation of subdivision identification signs. 4. The developer shall notify potential buyers about future roadway expansion and improvement projects for CR 47 and Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway projects. 5. Compliance with the City's tree preservation regulations, in accordance with the approved preliminary plat. 6. The developer shall include tree protection fencing on the plans for the trees to be preserved. Such fencing shall remain in place until all constriction in the area is completed. 7. Prior to recording the final plat, the following items shall be addressed and/or the final plat and plans shall be revised as follows: a. The applicant shall execute a Development Contract for the public and private improvements, and shall submit the required financial guarantees. b. The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time the final plat is recorded. c. The developer shall submit and receive City approval of the fire flow calculations. d. The developer shall provide a rain garden agreement for maintenance of the rain gardens. e. The developer shall submit homeowners association documents for City review, to ensure that maintenance of the association common spaces including sidewalks, landscaped medians, and similar features. f. All retaining walls over 4 feet high must be engineered walls. and a separate building permit will be required. g. Retaining walls shall not be located within drainage and utility easements or within the right-of-way. The City will need an encroachment agreement covering all walls in all phases constricted within or across any drainage & utility easement, such as the retaining wall shown on Sheet 7 of 13 covering Lots 5-10, Block 3. A single agreement can address all such encroachments. h. Poly -wrap all hydrant barrels. i. Bag all newly installed hydrants until they have been tested and put into service. j. Use current constriction details dated 2006 on all plan sheets. k. Use an 8 -inch wide external seal wrap, such as "Inf-Sheild" or approved equal on all sanitary sewer manholes. 1. Install Polymer Inflow/Infiltration barriers, such as those by "Strike Products" or approved equal with all sanitary sewer manhole adjusting ring installations. Resolution 2007-127 File 2007019 Page 3 m. Rip -rap for storm sewer shall be constricted using igneous or metamorphic rock (i.e., granite) 1 foot in diameter or larger and shall be hand placed. n. Trash Guards will be required on all 24 inch or larger flared end sections. o. Stop signs shall be R1-1 (30" x 30"). p. Identify Emergency Overflow Elevations on all adjacent ponds in and around the development. q. Revise Sheets 2 of 3 and 3 of 3 of the Final Plat to identify the underlying area as "OUTLOT A, TARYN HILLS 4TH ADDN." r. Revise hydrant locations shown in the plan views and place them in the boulevard 5 feet behind the curb per City Std. Detail W-2. Show this on all affected plan sheets. s. Add the following to the "Utility Notes" on Sheet 5 of 13: 1) Poly -wrap all hydrant barrels; and 2) bag all hydrants until they are tested and put into service. t. Modify Item 3 of the utility notes on Sheet 8 of 13 to read "24 inches or larger." u. Modify Item 4 of the utility notes on Sheet 8 of 13 to read "12 inches through 21 inches." v. Use 4.0 foot invert depth as a minimum for all storm sewer pipes and strictures where possible. w. Add an item to the utility notes on Sheet 8 of 13 stating "Granular material shall be placed under storm sewer pipe or strictures that are less than 48 inches below finished grade and extend to at least 48 inches below finished grade." x. Add 250 feet of drain tile up -stream from catch basins 181 & 182 on 58'11 Place N. y. Add 250 feet of drain tile up -stream from catch basins 178 & 179 on 59'11 Ave N. z. The developer shall supply a complete set of the approved constriction plans in an AutoCAD.DWG electronic file format at the time of the pre -constriction conference. 8. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Street names shall comply with the City's street naming system. c. Removal of all hazardous trees from the property at the owner's expense. d. The development shall comply with the Ordinance regarding location of fire hydrants. e. All street water mains shall be looped. f. A reproducible 8 1/z x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any financial guarantees. g. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. h. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
