HomeMy WebLinkAboutCity Council Resolution 2007-125CITY OF PLYMOUTH RESOLUTION 2007-125 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR U.S. HOME CORPORATION FOR "TARYN HILLS 5"' ADDITION" FOR PROPERTY LOCATED SOUTHEAST OF COUNTY ROAD 47 AND VICKSBURG LANE (2007018) WHEREAS, U.S. Home Corporation has requested approval of a final plat for 85 multi -family lots and five outlots on roughly 25 acres of land located southeast of County Road 47 and Vicksburg Lane in the "Taryn Hills" plat; and WHEREAS, the property is presently legally described as follows: Outlot M, Taryn Hills, Hennepin County, Minnesota, according to the recorded plat thereof. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by U.S. Home Corporation for a final plat for Taryn Hills 5t1' Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The plat is approved in accordance with the plans received by the City on February 22, 2007, except as may be amended by this resolution. Resolution 2007-125 File 2007018 Page 2 2. Development standards shall be as required by the RMF -3 district. No variances are granted or implied. 3. The developer must obtain a sign permit from the City Building Official prior to installation of subdivision identification signs. 4. The developer shall notify potential buyers about future roadway expansion and improvement projects for CR 47 and Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway projects. 5. Compliance with the City's tree preservation regulations, in accordance with the approved preliminary plat. 6. The developer shall include tree protection fencing on the plans for the trees to be preserved. Such fencing shall remain in place until all constriction in the area is completed. 7. Prior to recording the final plat, the following items shall be addressed and/or the final plat and plans shall be revised as follows: a. The applicant shall execute a Development Contract for the public and private improvements, and shall submit the required financial guarantees. b. The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time the final plat is recorded. c. The developer shall submit and receive City approval of the fire flow calculations. d. The developer shall provide a rain garden agreement for maintenance of the rain gardens. e. The developer shall submit homeowners association documents for City review, to ensure that maintenance of the association common spaces including sidewalks, landscaped medians, and similar features. The HOA documents shall include language prohibiting storage in the parking spaces of the multi -family areas—including storage of recreational vehicles. f. In conjunction with recording of the final plat, the developer shall provide a ten -foot wide trail easement on lots and out lots abutting Vicksburg Lane and CR 47 within the plat. g. All retaining walls over 4 feet high must be engineered walls. and a separate building permit will be required. h. Retaining walls shall not be located within drainage and utility easements or within the right-of-way. i. Poly -wrap all hydrant barrels. j. Bag all newly installed hydrants until they have been tested and put in service. k. Use current constriction details dated 2006 on all plan sheets. 1. Use an 8 inch wide external seal wrap, such as "Inf-Sheild" or approved equal on all sanitary sewer manholes. in. Install Polymer Inflow/Infiltration barriers, such as those by "Strike Products" or approved equal with all sanitary sewer manhole adjusting ring installations. Resolution 2007-125 File 2007018 Page 3 n. Rip -rap for storm sewer shall be constricted using igneous or metamorphic rock (i.e., granite) 1 foot in diameter or larger and shall be hand placed. o. Trash guards will be required on all 24 inch or larger flared end sections. p. No Parking signs shall be R7 -2A (12" x 18"). q. Stop signs shall be R1-1 (30" x 30"). r. Remove item 1 on the note for Sheet 8 of 23—does not apply. s. Modify item 7 on the note for Sheet 8 of 23 (remove reference to 20 inch watermain). t. Modify item 12 on the note for Sheet 8 of 23 (add "and Specifications" after "ENGINEERING GUIDELINES"). u. Remove high point in watermain between Stations 6+00 and 8+25 shown in profile on Sheet 9 of 23. v. Remove high point in watermain between Stations 0+75 and 1+75 on CMA2--Private Drive 4 shown in profile on Sheet 10 of 23. w. Remove high point in watermain between Stations 0+00 and 1+00 on CMS1--Private Drive 1 shown in profile on Sheet 11 of 23. x. Add an 8 inch gate valve to watermain on the east end of CMS 1 Private Drive 1 at approximately station 3+25 on Sheet 11 of 23. y. Insert a note on all utility sheets for private drives that states: "The City of Plymouth is responsible for the maintenance of the sewer and water main lines only. Maintenance and repairs of the sewer and water services lines from the main to the units are not the responsibility of the City." z. Remove high point in watermain between Stations 0+00 and 1+50 on CMA2--Private Drive 7 shown in profile on Sheet 12 of 23. aa. Loop the 8 inch watermain from the north end of CMS2 Private Drive 3 and connect it to the 20 inch watermain along Vicksburg Lane using a wet tap and 8 inch gate valve. bb. Modify item 4 on the note for Sheet 15 to read "flared end sections 24 inches or larger". cc. Use 4.0 foot invert depth as a minimum for all storm sewer pipes and strictures where possible. dd. Add item 7 on the notes for Sheet 15 stating "Granular material shall be placed under storm sewer pipe or strictures that are less than 48 inches below finished grade and extend to at least 48 inches below finished grade." ee. Call out Emergency Overflow Elevations on all adjacent ponds in and around the development. ff. Private drive 46 turn -around dimensions must be revised to comply with Fire Department requirements. gg. The developer shall supply a complete set of the approved constriction plans in an AutoCAD.DWG electronic file format at the time of the pre -constriction conference. 8. Prior to issuance of building permits permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 9. Prior to issuing certificates of occupancy, the developer shall install unit address/ directional signage on the private drives where they intersect with public roadways. Resolution 2007-125 File 2007018 Page 4 10. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Street names shall comply with the City's street naming system. c. Removal of all hazardous trees from the property at the owner's expense. d. The multi -family strictures shall be protected by a City approved automatic fire sprinkler system. e. The development shall comply with the Ordinance regarding turning radius, fire lane constriction, location of fire hydrants, lock boxes, post -indicator valves, fire department connections, and fire lane signage. f. All street water mains shall be looped, and the water main system shall be looped for all cul-de-sac streets that exceed 500 feet in length. g. A reproducible 8 '/z x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any financial guarantees. h. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. i. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
