RESOLUTION 2007 - 124
APPROVING A SITE PLAN AND VARIANCES FOR TWIN CITIES HABITAT FOR
HUMANITY FOR A FOUR -UNIT TOWNHOUSE STRUCTURE FOR PROPERTY
LOCATED AT 10801 SOUTH SHORE DRIVE (2007008)
WHEREAS, Twin Cities Habitat for Humanity has requested approval of a site plan and
variances for a 4 -unit townhouse stricture for a one -acre site located at 10801 South Shore
Drive; and
WHEREAS, the property is legally described as follows:
All that part of the northwest quarter of the northwest quarter of Section 36, Township
118, Range 22, described as follows:
Commencing at a point on the east line of said northwest quarter of the northwest
quarter of said Section, which is 129 feet south of the southerly line of right-of-way of
Electric Short Line Railway; thence west to the center line of said center line of
Medicine Lake Road; thence northerly along said center line to the intersection of said
center line and southerly line of right-of-way of said Electric Short Line Railway;
thence easterly to the east line of said northwest quarter of the northwest quarter;
thence southerly to the point of beginning, Hennepin County, Minnesota. And,
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Twin Cities Habitat for Humanity for a site plan and variances for property located at 10801
South Shore Drive, subject to the following conditions:

1. A site plan is approved for a four -unit townhome development, in accordance with the
application and plans received by the City on January 29, 2007 and February 16, 2007,
except as may be amended by this resolution.
2. Variances are approved to allow 1) a six-foot sideyard setback from the north property line
and a 6.8 -foot setback from the south property line; 2) a 20 -foot parking setback from
South Shore Drive; and 3) an eight -foot driveway setback on the south side of the
property, based on the findings that the applicable standards have been met.
3. Prior to the commencement of any construction, the applicant shall receive the
appropriate building permits.
4. Prior to issuance of building permits, the following items shall be provided or shown on
the plans:
a. Add the 15 -foot wetland setback to the plans north of the stricture and note the
location of the wetland buffer posts across the east side of the property consistent with
the Zoning Ordinance.
b. Add a hydrant near the entry drive but outside the trail easement.
c. Tree preservation fencing shall be installed and inspected by City staff. The fencing
must remain through the constriction process.
d. The following easement/agreement documents shall be submitted as separate
documents and recorded:
i. A 13.5 -foot easement for right-of-way purposes to increase the right-of-way from
16.5 feet from the existing centerline to 30 feet from the existing center line.
ii. A ten -foot drainage and utility easement adjacent to the easement for South Shore
Drive (described in i. above) and a six-foot easement along the side and rear
property lines.
iii. A ten -foot trail easement adjacent to the easement for South Shore Drive
(described in i. above).
iv. A drainage and utility easement for the wetland up to the 100 -year high water
elevation.
v. A maintenance agreement for the rain garden.
e. Copies of the following permits shall be submitted:
i. A dewatering permit from the DNR (as may be applicable).
ii. A permit to cap the well from the MN Dept. of Health (as may be applicable).
iii. Bassett Creek Watershed District.
f. The following fees shall be paid or assessed to the property: 1) $2,945.82 for the
watermain area charge and 2) $13,332 for the future reconstruction of South Shore
Drive.
g. Revise the proposed infiltration area on the northwest part of the property into a rain
garden. Submit a planting schedule showing the type and quantity of plants.
h. The disturbed area along the south property line shall have filter compost installed per
the detail on page 4 of 8, or a similar detail subject to City approval.

i. Indicate the lowest floor elevation on the grading plan, and label the proposed building
as a slab on grade (no basement).
j. Identify the flood plain elevation as 889.1 on the plans.
k. Identify all curbs ouside the apron area as surmountable.
1. Indicate on the utility plans that there are 4 individual sanitary sewer services.
m. Use the current City details per the Engineering Guidelines. Update details W-4, DWG -
9 and 10.
n. Under Constriction Notes on page 5, revise note 45 that gate valves shall be AFC
2500 series; note 411 to contact the Engineering Department at 763-509-5500; note
412 revise date from 1998 to 2005; note 414 add within 48 hours at the end of the
paragraph.
o. Any off-site disturbance to adjacent property requires the written permission of the
property owner.
p. Note that founding utility lines on peat soils may require special geotechnical
engineering considerations.
5. Standard Conditions:
a. The minimum floor elevation shall be 893.1.
b. City staff must be present while compost (used as a BMP) is being applied to the
property.
c. The City requires reproducible mylar prints of the fire protection plan, sanitary sewer,
water service, and storm sewer as-builts submitted and approved by City staff prior to
scheduling a final inspection.
d. Address signage, as approved by the City, shall be required for this development.
e. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless the
landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Sections 21045.09 and
2 103 0. 06 of the Zoning Ordinance.
