RESOLUTION 2007-085
APPROVING ENCROACHMENT AGREEMENT FOR
ALLOWING RETAINING WALLS TO OCCUPY
A DRAINAGE AND UTILITY EASEMENT
AT 5625 GLACIER LANE
WHEREAS, Thomas S. Childs has requested approval to execute an encroachment agreement to
allow for existing retaining walls to occupy a public drainage and utility easement; and;
WHEREAS, the encroachment agreement only permits the encroachment of the existing retaining
walls within the easement and all related facilities must still meet all applicable City codes; and
WHEREAS, the property is legally described as Lot 23, Block 3, Glacier Vista;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for the existing retaining
walls to occupy a public drainage and utility easement.
