RESOLUTION 2007-082
APPROVING A CONDITIONAL USE PERMIT FOR CVS PHARMACY FOR
PROPERTY LOCATED AT 4140 COUNTY ROAD 101 (2006122)
WIffiREAS, McClay-Alton, PLLP has requested approval of a conditional use permit to
allow CVS Pharmacy to operate the existing drive-through window 24-hours/day for the
property located at 4140 County Road 101, legally described as follows:
Lots 1, 2, 3, and 4, Block 1, Hughston Addition, according to the recorded
plat thereof, Hennepin County, Minnesota.

That part of the North Half of the Southeast Quarter of the Northeast
Quarter of Section 18, Township 118, Range 22, described as follows:
Commencing at the intersection of the South boundary line of the North
Half of the Southeast Quarter of Northeast Quarter of Section 18,
Township 118, Range 22 and the Southwesterly boundary line of new
State Highway Number 55; thence Northwesterly along said boundary line
231.25 feet; thence at an angle Southwesterly to a point on the East
boundary line of Highway No. 101, 78.15 feet to a point 135.6 feet North
of the intersection of the South boundary line of said North Half of the
East boundary line of said Highway No. 101; thence South along highway
line 135.6 feet; thence East to the point of beginning, according to the
United States Government Survey thereof and situate in Hennepin County,
Minnesota.
WI-1EREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing, and recommends approval.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by McClay and Alton, PLLP for a conditional use permit for CVS Pharmacy to
operate the existing drive-through window 24-hours/day, subject to the following
conditions:
1. A conditional use permit is hereby approved in accordance with the application
received by the City on December 28, 2006, except as may be amended by this
resolution.
2. The conditional use permit allows for the 24-hour/day operation of the drive-through
service window, in compliance with Sections 21120.09 and 21460.07 of the Plymouth
Zoning Ordinance.
3. The sale or serving of alcoholic beverages from the drive-through window is
prohibited.
4. Standard Conditions:
a. Any signage shall comply with the City's sign regulations, and shall receive prior
approval of the appropriate sign permit.
b. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
c. This permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
d. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07
of the Zoning Ordinance.
