HomeMy WebLinkAboutCity Council Resolution 2007-079CITY OF PLYMOUTH RESOLUTION NO. 2007-079 ORDERING IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS 2007 STREET RECONSTRUCTION PROJECT CITY PROJECT NO. 7107 WHEREAS, the City Council adopted a resolution on the 9t1' day of January, 2007, which fixed a date for a council hearing on the proposed improvement of City View Acres, located south of County Road 6 to, and including 9t1' Avenue, from County Road 101 to, and including Dunkirk Lane and 14t1' Avenue, east of Dunkirk Lane; and WHEREAS, the proposed project includes the reconstruction of streets to include concrete curb and gutter installation, storm sewer installation and repair, roadway resurfacing and all necessary appurtenances; and WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the hearing will be held thereon the 13t1' day of February, 2007, at which all persons desiring to be heard will be given an opportunity to be heard thereon, and WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes) since the project has not been petitioned for by the benefiting owners. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plymouth City Council of the City of Plymouth, Minnesota: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 2. Such improvement is hereby ordered as proposed in the Council resolution adopted February 13, 2007. 3. The Plymouth Engineering Department is designated as engineer for the improvement. They shall prepare plans and specifications for the making of such improvement and that the Engineering Department shall examine the feasibility of designing a storm drainage system that would limit the use of traditional concrete curb and gutter and storm drainage pipe and instead could include the use of "ribbon" style curbing and boulevard infiltration drainage. 4. The city council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of the tax exempt bond. Adopted by the City Council on February 13, 2007.
