RESOLUTION NO. 2007-078
ORDERING IMPROVEMENT AND PREPARATION OF
PLANS AND SPECIFICATIONS
2007 STREET RECONSTRUCTION PROJECT
CITY PROJECT NO. 7101
WHEREAS, the City Council adopted a resolution on the 9t1' day of January, 2007, which
fixed a date for a council hearing on the proposed improvement of Hawthorne Ponds,
located west of County Road 101 to, and including, Queensland Lane, from the Luce
Line Trail to 6th Avenue, including 2nd Avenue and 3rd Avenue west of Queensland Lane,
and Narcissus Lane north of 6th Avenue, but excluding 6t1' Avenue east of Queensland
Lane; and
WHEREAS, the proposed project includes the reconstruction of streets to include
concrete curb and gutter installation, storm sewer installation and repair, watermain
replacement, roadway resurfacing and all necessary appurtenances; and
WHEREAS, ten days mailed notice and two weeks published notice of the hearing was
given, and the hearing will be held thereon the 13t1' day of February, 2007, at which all
persons desiring to be heard will be given an opportunity to be heard thereon, and
WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes)
since the project has not been petitioned for by the benefiting owners.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plymouth City Council of
the City of Plymouth, Minnesota:
I. Such improvement is necessary, cost-effective, and feasible as detailed in the
feasibility report.
2. Such improvement is hereby ordered as proposed in the Council resolution adopted
February 13, 2007 except the area including 3rd Avenue from approximately 450 feet
west of 2nd Avenue including Queensland Lane, from the Luce Line Trail to 6t1' Avenue,
including 2nd Avenue and 3rd Avenue west of Queensland Lane and Queensland Court
east of Queensland Lane which is continued for fi rther discussion on February 27, 2007.
3. The Plymouth Engineering Department is designated as engineer for the improvement.
They shall prepare plans and specifications for the making of such improvement.
4. The city council declares its official intent to reimburse itself for the costs of the
improvement from the proceeds of the tax exempt bond.
