APPROVING A CONDITIONAL USE PERMIT FOR FASTENAL TO ALLOW 2
PERCENT ACCESSORY RETAIL IN THE I-2 (GENERAL INDUSTRIAL) ZONING
DISTRICT FOR PROPERTY LOCATED AT 2530 XENl[_ M LANE NORTH

WHEREAS, Fastenal has requested approval of a conditional use permit to allow 2
percent accessory retail for property located at 2530 Xenium Lane North, legally
described as follows:
Tract B, Regisetered Land Survey No. 991, files of the Registrar of Titles, County of
Hennepin.
Also:
The north 3 00. 5 feet of that part of the North Half of the Northeast Quarter of Section 27,
Township 118 North, Range 22 West of the 5"' Principal Merdian, lying westerly of the
southwesterly right of way line of new State Think Highway 55.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing, and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Fastenal for a conditional use permit to allow 2 percent accessory retail sales,
subject to the following conditions:
1. A conditional use permit is hereby approved in accordance with the application
received by the City on December 8, 2006 and revised site plan received on January 5,
2007, except as may be amended by this resolution.

2. The conditional use permit allows 2 percent or 94 square feet of the gross floor area of
the Fastenal tenant space to be used as accessory retail sales, based on the finding that
all applicable conditional use standards have been met.
3. No outdoor storage or sales related to the retail area is permitted with the conditional
use permit.
4. All waste and waste containers shall be stored within approved designated areas.
5. Standard Conditions:
a. Any signage shall be in compliance with the City's sign regulations, and shall
receive prior approval of the appropriate sign permit.
b. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
c. This permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
d. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07
of the Zoning Ordinance.
