RESOLUTION NO. 2007-035
AUTHORIZE EXECUTION OF THE ADDENDUM TO THE EXISTING LEASE
WITH T -MOBIL CENTRAL TO LOCATE PERSONAL COMMUNICATION
ANTENNAS AT BASS LAKE PLAYFIELDS
WHEREAS, The City of Plymouth has a lease with T -Mobile Central to lease them space at the Bass
Lake Playfield for the purpose of mounting cellular antennas and,
WHEREAS, the lease was approved at the November 14, 2006 council meeting and,
WHEREAS, the City accepts the addendum to this lease as follows
Current language to be deleted entirely:
Subsection 7(c)
(c) Upon termination, Operator shall promptly remove the equipment described in Section 2A and
restore land and property to its original condition, excluding ordinary wear and tear. Operator shall
submit a letter of credit or performance bond (in a form acceptable to Operator's surety) or other
form of security, which alternate form of security must be acceptable to the City, to cover the costs
of removal.
Language to be added with the addendum:
Subsection 7(c) is deleted in its entirety and replaced with the following:
(c) Upon expiration or termination of this Agreement, Operator shall promptly remove all of its
improvements, with the exception of the light pole and light fixtures, and provide City with a Bill
of Sale for the light pole. Operator will restore the Premises to substantially the same condition
which existed at the time this Agreement was executed, light pole notwithstanding, and ordinary
wear and tear excepted. Footings, foundations and concrete not associated with the light pole will
be removed to a depth of one (1) foot below grade.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA. That the Mayor and City Manager are authorized to execute the
addendum to the existing lease with T -Mobile Central to locate personal communication antennas on a
light pole in the Bass Lake Playfield.
