HomeMy WebLinkAboutCity Council Resolution 2008-356CITY OF PLYMOUTH RESOLUTION 2008-356 APPROVING A SITE PLAN AMENDMENT AND INTERIM USE PERMIT FOR LIBERTY PROPERTY TRUST, INC. FOR PROPERTY LOCATED AT 4700 NATHAN LANE (2008101) WHEREAS, Liberty Property Trust, Inc. has requested approval of a site plan amendment and interim use permit for property legally described as: That part of Lot 1, Block 1, Drakeland Business and Technical Center, lying Northerly, Northeasterly and Northwesterly of the following described line and its Westerly extension: Commencing at the most Easterly Southeast corner of said Lot; thence on an assumed bearing of North 00 degrees 59 minutes 09 seconds East, along the East line of said Lot 1, a distance of 129.00 feet to the point of beginning of said line; thence North 68 degrees 34 minutes 54 seconds West 405.40 feet; thence North 45 degrees 43 minutes 18 seconds West 786.63 feet; thence South 69 degrees 17 minutes 27 seconds West; 63.62 feet to the intersection with the West line of said Lot 1 and said line there terminating. Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Liberty Property Trust, Inc. for a site plan amendment and interim use permit for property located at 4700 Nathan Lane, subject to the following conditions: A site plan amendment to allow the constriction of an 85,780 square foot addition and related improvements is hereby approved, in accordance with the plans received by the City on October 1, 2008, except as may be amended by this resolution. 2. An interim use permit for reduced parking to allow 600 parking spaces where the Zoning Ordinance requires 694 spaces is hereby approved, based on the finding that the applicable interim use standards have been met. The interim use permit for reduced parking shall expire if and when the City determines that there is a parking shortage on the site. At such time, the landowner shall obtain the appropriate approvals and constrict additional parking spaces on the site in compliance with the Zoning Ordinance requirement or an amended interim use permit for reduced parking. Resolution 2008-356 (2008101) Page 2 4. Separate building permits are required prior to commencement of the proiect. Separate permits are also required to relocate the existing nitrogen tank and generator. 5. Prior to issuance of the building permit, the applicant shall submit the following information or revise the plans consistent with the Zoning Ordinance, City Code and current Engineering Guidelines and as follows: a. Revise the landscaping plan to replace the northern pin oak and Norway pine with species that better tolerate Plymouth soils like red, swamp, white or bur oaks and Scotch pine. Additionally, move the trees proposed on the southeast side of the cul-de-sac as necessary to avoid conflicts with City fire apparatus. b. Revise the lighting plan to 1) include a lighting power allowance table; 2) reconcile the number of light fixtures shown on the elevation drawings with those on the lighting plan; 3) consider all lights on the building as facade lighting and include the category in the lighting power allowance table; and 4) revise the area calculations for the parking area, entries, and walkway area lighting and reduce the wattage proposed as may be necessary. c. Revise the site and civil plans consistent with the exhibit submitted October 28, 2008 illustrating parking and drive -aisle dimensions consistent with Zoning Ordinance requirements. Alter General Note 7 on page C4.0 to be consistent with the Zoning Ordinance. d. Revise the elevation drawings to indicate the color of the screen walls would be similar to the brick. e. Identify the location for the bicycle storage and consider locating the storage area inside the building or under a cover. f. During winter conditions, consider plowing a walkway on the opposite side of Nathan Lane between the trail and the roadway to allow employees that commute by transit the ability to cross the street. g. Consider providing financial incentives for employees who take alternative transportation. h. Submit a list of any hazardous materials and the quantity typically stored or used on the site. i. Identify the fire department connection and relocate the post indicator valve to an approved location. j. Add fire lane signs in approved locations. k. Revise the width of the entry of the fire lane as necessary to avoid conflicts with City fire equipment. 1. Submit the required, signed Site Improvement Performance Agreement and related financial guarantees. in. Submit copies of the following permits or approvals: Bassett Creek Watershed, a drainage discharge permit from Mn/DOT, MPCA for sanitary sewer extension and NPDES. n. Submit separate descriptions of the following and revise the grading permit as follows: 1) demonstrate that the increased volume of runoff due to development is minimized by limiting impervious cover and encouraging infiltration of storm water where soil conditions are appropriate; Resolution 2008-356 (2008101) Page 3 2) describe the use of alternative landscape techniques and materials that would be used to reduce rates and volumes of runoff, 3) identify all reasonable steps to avoid water quality impacts and mitigate with appropriate best management practices (BMPs) to prevent water quality in receiving waters from falling below established standards. o. Note on the utility plan that all new utilities are privately maintained. p. Demonstrate that the driveway trench drains for the bottom of the underground parking and at grade driveway are capable of handling the 100 -year rain event. q. Driveway slopes in excess of five percent may become problematic during wet freezing weather or snow conditions. Consider taking remedial steps to minimize the potentially slippery conditions. r. Show the percent of grade for both driveways and fire department cul-de-sac road on the plan. s. Use SDR26 for the sanitary sewer pipe run between MM3 and MM2. SDR26 is required for depths exceeding 15 feet. t. In the storm sewer table on page C3.0 revise the casting for CBB, 16, 17, and 18 from R- 2535 to R-2573. Also, note that the casting (R-4342) for CB 11, 12, and 13 shall have a concrete frame. u. Relocate the proposed watermain gate valve (located north of the proposed driveway) to the beginning of the new watermain located north of the existing building. v. Identify the PIV and water service in the plan view as indicated by Keyed Note 12 on page C3.0. w. Install a new gate valve on the new water service. If existing water services to the existing building are to be rerouted, then add a note to the plans to plug the Tees, remove the existing pipe, and provide additional detail. x. Install a new gate valve at the beginning of the new water main located on the south side of the existing building (the valve may be relocated south of the southerly fire hydrant adjacent to the proposed building addition). 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 7. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. No variances are granted or implied. 8. Standard Conditions: a. Prior to the release or reduction of any site improvement financial guarantee, the applicant shall submit mylar copies of an 8 1/2 x 11 inch "As Built" Fire Protection Plan as well as sanitary sewer, water service, storm sewer and pond "as -built' plans. b. Any retaining walls over four feet shall require a separate building permit and shall include a three-foot fence installed on top. c. Trash storage and mechanical equipment shall be screened as required by the Zoning Ordinance. Resolution 2008-356 (2008101) Page 4 d. All mechanical equipment and the generator shall be installed and maintained consistent with the noise regulations in City Code. e. Signage shall be consistent with the Zoning Ordinance. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning Ordinance.
