HomeMy WebLinkAboutCity Council Resolution 2008-354CITY OF PLYMOUTH RESOLUTION 2008-354 APPROVING A REGISTERED LAND SURVEY FOR THE CITY OF PLYMOUTH TO SUBDIVIDE PROPERTY LOCATED AT 5755 JUNEAU LANE. (2008030) WHEREAS, the City of Plymouth has requested approval of a registered land survey to subdivide a property to create a separate parcel for acquisition for the Northwest Greenway trail corridor on property located at 5755 Juneau Lane, and WHEREAS, the property is legally described as follows: Township 118 North, Range 22 West, Section 4: The North 333 feet of the East 687 feet of Government Lot 2. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the City of Plymouth for a registered land survey to create a separate parcel for the Northwest Greenway trail corridor on property located at 5755 Juneau Lane N, subject to the following findings and conditions: 1. The registered land survey is approved in accordance with the application and plans received by the City on April 11, 2008 and October 14 and 17, 2008, except as may be amended by this resolution. 2. Approval of this registered land survey is contingent on approval of variances to lot area, lot width and access to a public right-of-way. 3. The requirement for sidewalks along Juneau Lane is hereby waived as: 1) a sidewalk across one lot would be inconsistent with the rest of the neighborhood and 2) due to the topography of the area, sidewalks and any necessary retaining walls would be more efficiently completed with the fiiture Juneau Lane reconstruction project. 4. Prior to recording the RLS, the applicant shall submit a separate easement document consistent with the regulations in the Subdivision Regulations that establishes an eight -foot easement along the front property line for Tract B. 5. Recorded copies of the following documents shall be submitted to the City: a) a recorded copy of the registered land survey and b) a recorded copy of the drainage and utility easement. The wetlands shall be delineated and wetland buffers shall be established consistent with the Zoning Ordinance in Tract A prior to constriction of the trail on Tract A and on Tract B prior to any further subdivisions or redevelopment on Tract B. 7. Tree preservation requirements shall apply to any further subdivision or redevelopment of Tracts A and B. 8. Park dedication shall apply to any further subdivision or redevelopment of Tract B. 9. This approval shall expire one year after the date of approval, unless the property owner or applicant has recorded the RLS, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of City Code.
