FOR "GUTLOVICS ADDITION" TO CREATE THREE LOTS ON PROPERTY LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF 26TH AVENUE AND COUNTY ROAD 101 (200704 1) WHEREAS, Gartner Engineering, LLC. has requested approval of a preliminary and final plat for "Gutlovics Addition," a plat to create three lots for single-family dwellings on 1.69 acres located at the northwest corner of the intersection of 26"' Avenue and County Road 101; and WHEREAS, the property is legally described as follows: That part of the Southwest Quarter of the Southeast Quarter of Section 19, Township 118, Range 22 described as follows: Commencing at a point on the East line of the West 1000.0 feet of said Southwest Quarter of the Southeast Quarter, distant 261.36 feet north of the South line thereof, thence south along said East line 125.0 feet; thence East to a point in the East line of said Southwest Quarter of the Southeast Quarter, distant 155.23 feet north of the South line thereof, thence North along said East line 125.02 feet; thence west to the point of beginning. Subject to easement for highway purposes over the East 3 3.0 feet thereof. That part of the Southwest Quarter of the Southeast Quarter lying East of the West 1000.0 feet thereof and South of a line drawn from a point on the East line of said Southwest Quarter of the Southeast Quarter, distant 155.23 feet North from the Southeast corner thereof to a point on the East line of the West 1000 feet of the Southwest Quarter of the Southeast Quarter, distant 136.36 feet North from the South line of the Southwest Quarter of the Southeast Quarter, Section 19, Township 118, Range 22, according to the government thereof, subject to 16.5 feet Cart way easement along the South line and a 33.0 foot road easement along the East line thereof as shown in Deed Document No. 559469, file of the Registrar of Titles. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Gartner Engineering, LLC. for a preliminary and final plat to be called "Gutlovics Addition" for property located at the northwest corner of the intersection of 26"' Avenue and County Road 101, subject to the following conditions: Resolution No. 2008-347 2007041 Page 2 1. This preliminary and final plat approves three lots for single-family dwellings, in accordance with the plans received by the City on April 26, 2007, June 2, 2008, September 2008, except as amended by this Resolution. 2. This approval waives the requirement for sidewalks to be installed on 26t1i Avenue. 3. The development shall comply with all standards specified for the RSF-I (Residential Single Family 1) zoning district. No variances are granted or implied. 4. Adjacent paved streets shall be kept free of mud, sand, and silt as a result of constriction. 5. Access to County Road 101 for Lots 2 and 3 is denied. Private driveway accesses for Lots 2 and 3 shall be from 26'11 Avenue North. 6. Prior to construction of any new structure or grading activity on the site, the applicant shall obtain all necessary permits. 7. Prior to removal of any trees, the applicant shall: a. Install tree preservation fencing as required by the Subdivision Ordinance and such fencing shall be inspected and approved by City staff. b. Submit a tree preservation financial guarantee in an amount based on the adopted rates at that time. 8. Prior to recording the final plat or issuance of a trading permit, the applicant shall submit the following or revise the plans consistent with the Zoning Ordinance, City Code and the most current version of Engineering Guidelines as follows: a. The applicant shall remove the driveway and raised planting bed encroachment over the proposed lot line and restore with turf as required in Section 21130.03 b. Revise the tree preservation plan to consider tree 443 to be disturbed. c. Park dedication shall be paid prior to recording the final plat. The fees shall be calculated based on the adopted rates at that time. d. Submit cost estimates for all on-site improvements, including, but not limited to, rain garden constriction, sewer/water connections, private storm -sewer improvements (including swale constriction/restoration, pipe, catch basins, sump pump, etc.) sod, corner monuments, etc.; sign the required Site Improvement Performance Agreement; and submit financial guarantees pursuant to Section 21045.10 of the Zoning Ordinance. e. Revise the plan notes to reflect that the entire storm sewer system located on private property (except the outlet pipe to 26'11 Avenue) shall be privately maintained. f. Consider installing reinforced concrete pipe (RCP) at the storm sewer apron ends. g. Revise the rain garden notes to reflect only one rain garden. Show amended soil (cross section detail) for a depth of 30 inches below the bottom of the rain garden. Raise the bottom of the rain garden to elevation 997.0. Provide a planting plan to show the type of plants, size, location, and quantity. Resolution No. 2008-347 2007041 Page 3 h. Remove the reference to MNDOT Standard Plate 400313 for the storm sewer manholes and include City Detail ST -6 on the plans. i. Place the following note on the plans: "All new storm sewers shall be inspected by the Engineering Division. Call 763-509-5500 a minimum of 48 hours in advance to schedule an inspection. The owner shall provide a CD/DVD of a video inspection to the City." j. Verify with Hennepin County and clearly show the emergency overflow elevation on 26t11 Avenue for the rain garden. k. Submit the following easements and signed agreements: i) Standard drainage and utility easements (on the final plat): 1) a 10 -foot wide drainage and utility easement adjacent to all street right-of-ways and 2) a six-foot wide easement for all side and rear property lines, not five feet as shown. ii) A drainage and utility easement is required to accommodate storm water discharge from 18000 26'11 Avenue through Gutlovics Addition to its discharge point on 26'11 Avenue. iii) A temporary constriction easement to allow the purchasers of Lot 3 to constrict the improvements on Lot 2. iv) A rain garden maintenance agreement for the rain garden on Lot 3. v) Right-of-way shall be shown as follows: 1) 60 feet from the centerline of County Road 101 and 2) 30 feet for 26'11 Avenue. 1. Add the following to the mylar copy of the plat: i) A signature block for the City Engineer. ii) Revise the drainage and utility easement to indicate six feet along side and rear property lines, not five feet as shown. iii) The words "drainage and utility easement" to the Mylar plat for the large easement areas shown on the plat. Provide arrows to show the easement boundary. iv) The driveway culvert must be included in the drainage and utility easement. 9. Prior to issuance of a building permit, the applicant shall: a. Submit proof of recording from Hennepin County for the final plat and any separate easements and agreements. b. Submit written permission from affected adjacent property owner(s) for any grading that is proposed to occur off the lot for which a building permit has been requested. c. Install erosion control fencing and such fencing shall be inspected and approved by City staff. 10. The developer shall obtain the necessary permits and approvals as follows: Hennepin County (if working in the County Road 101 right-of-way); Minnehaha Creek Watershed District, NPDES and City of Plymouth street right-of-way permit. 11. It is the owner's responsibility to install and operate the temporary pump station for the storm water north of 26'11 Avenue until such time as the permanent storm sewer pipe is installed by Hennepin County. Resolution No. 2008-347 2007041 Page 4 12. Lot 3 may use the existing sanitary service in 26"' Avenue, but a new water service shall be provided. The developer is responsible for repairing 26"' Avenue for any disturbance related to the project, including (but not limited to) the curb and gutter and boulevard restoration. The applicant may also petition to have the City constrict the water service with the County Road 101 project, with the costs assessed to the property. 13. The existing water service to 17930 26"' Avenue and any portion of the sanitary sewer service that crosses the property line shall be abandoned. 14. The minimum floor elevations shall be as follows: the lowest opening (door or window) shall be a minimum of 18 inches higher than the overland emergency overflow elevation, as is shown for the east and west sides of Lot 3. 15. Standard Conditions: a. All hazardous trees shall be removed from the property at the owner's expense. b. No retaining walls shall be located within any right-of-way or drainage and utility easement. Any wall over four feet in height requires a separate building permit and fencing shall be installed on top. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. This approval shall expire two years after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
