RESOLUTION NO. 2008-341
REQUEST FOR PAYMENT NO. 3 AND FINAL
MOONEY LAKE EMERGENCY
OUTLET PROJECT
CITY PROJECT NO. 7111
WHEREAS, the City of Plymouth as owner and Dave Perkins Contracting, Inc., as
contractor, have entered into an agreement for the Mooney Lake Emergency Outlet
Project, City Project No. 7111, said agreement being dated October 9, 2007; and
WHEREAS, the Engineering Division has certified acceptance of the work and approval
of the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $161,807.00. The work to date is
$147,633.00 and is herewith approved. This project is less than the
original contract amount by $14,174.00, or 6.9%, due to changes in
constriction methods.
2. That the work performed by the contractor for the Mooney Lake
Emergency Outlet Project (7111) and certified to the Council by the
Engineering Division as acceptable, being the same, is hereby released
from the Engineering Division as acceptable from the contract except as to
the conditions of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work after final
payment.
3. Request for Payment No. 3 and Final in the amount of $17,000.40 to Dave
Perkins Contracting, Inc., which includes the release of previously held
retainages, for the Mooney Lake Emergency Outlet Project is hereby
approved and the City Finance Director is hereby authorized and directed
to pay the same forthwith.
