RESOLUTION 2008-333
APPROVING ENCROACHMENT AGREEMENT FOR
A MODULAR RETAINING WALL LOCATED AT 16650 32ND AVENUE
LOT 4, BLOCK 1, SPRING ARBOR (2007002)
WHEREAS, Keith and Kathy Martin have requested approval to execute an encroachment
agreement to constrict a modular retaining wall at 16650 32nd Avenue; and
WHEREAS, the encroachment agreement only permits the encroachment of the modular retaining
wall within the public easement and all related facilities must still meet all applicable City codes;
and
WHEREAS, the property is legally described as Lot 4, Block 1, Spring Arbor.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for a modular retaining
wall to encroach into a public drainage and utility easement.
Adopted by the City Council on October 28, 2008.
