RESOLUTION 2008-318
TERMINATING A 1990 CONDITIONAL USE PERMIT
THAT ALLOWED STOCKPILING OF DIRT ON PROPERTY
LOCATED AT 3500 HOLLY LANE (90036)
WHEREAS, in 1990 the City of Plymouth adopted Resolution 90-400 approving a conditional
use permit application by Hans Hagen Homes/Westar-Rome Partners that allowed stockpiling of
dirt on the property located north of Medina Road and west of County Road 24 (now known as
3500 Holly Lane) for fiiture use in their planned residential development south of Medina Road
and west of County Road 24; and
WHEREAS, 3500 Holly Lane is now legally described as Lot 1, Block 2, Plymouth Ponds
Business Park; and
WHEREAS, in 1992 the stockpile was removed from 3500 Holly Lane, thereby, making the
conditional use permit no longer needed; and
WHEREAS, in 1996 Moen Leuer Constriction, Inc. developed 3500 Holly Lane with industrial
warehouse/office use as part of their Plymouth Ponds Business Park; and
WHEREAS, Plymouth Ponds Development II, LLC (the current property owner) is requesting
that the City terminate the 1990 conditional use permit that allowed stockpiling of dirt at 3500
Holly Lane so the conditional use permit can be removed from the certificate of title.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does terminate the 1990 conditional
use permit authorized under Resolution 90-400 that allowed stockpiling of dirt on property
located at 3500 Holly Lane.
