HomeMy WebLinkAboutCity Council Resolution 2008-313CITY OF PLYMOUTH RESOLUTION 2008-313 APPROVING A PUD GENERAL PLAN AMENDMENT FOR LCS, LLC FOR "TRILLIUM WOODS," A CONTINUING CARE RETIREMENT COMM[_]NITY ON PROPERTY LOCATED AT THE INTERSECTION OF COUNTY ROAD 47 AND JUNEAU LANE (2008085) WHEREAS, LCS, LLC has requested approval of a PUD general plan amendment for property legally described as follows: Parcel 1: That portion of the Southeast Quarter of the Northeast Quarter (SE '/4 of the NE '/4) of Section 4, Township 118, Range 22, lying Southerly of Hennepin County Highway 47, except for the following tracts of land: Tract 1: The East 200 feet of the Southeast Quarter of the Northeast Quarter (SE '/4 of the NE '/4) of Section 4, Township 118, Range 22 lying Southerly of Hennepin County Highway No. 47; and Tract 2: That part of the East Half of the Northeast Quarter (E '/z of the NE '/4) of Section 4, Township 118 North, Range 22 West, Hennepin County, Minnesota, described as beginning at the point of intersection of the center line of County Road No. 47 and a line parallel with and 223.00 feet Easterly, as measured at right angles, from the West line of the East Half of said Northeast Quarter (E '/z of said NE '/4); thence South along said parallel line a distance of 162.34 feet; thence deflecting to the left 90 degrees 00 minutes, a distance of 190.00 feet; thence deflecting to the left 90 degrees 00 minutes, a distance of 165.25 feet to the center line of County Road 47; thence West along said center line to the point of beginning. Parcel 2: That part of the East Half of the Northeast Quarter (E '/z of the NE '/4) of Section 4, Township 118, Range 22 West, Hennepin County, Minnesota, described as beginning at the point of intersection of the center line of County Road 47 and a line parallel with and 223.00 feet Easterly, as measured at right angels, from the West line of the East Half of said Northeast Quarter (E'/z of the NE '/4); thence South along said parallel line a distance of 162.34 feet; thence deflecting to the left 90 degrees 00 minutes, a distance of 190.00 feet; thence deflecting to the left 90 degrees 00 minutes, a distance of 165.25 feet to the center line of County Road No. 47; thence West along said center line to the point of beginning. Along with: Resolution 2008-313 File No. 2008085 Page 2 The North 600 feet of Government Lot 1, Section 4, Township 118, Range 22, Hennepin County Minnesota, except the East 150.00 feet thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by LCS, LLC for a PUD general plan amendment, subject to the following conditions: 1. A PUD general plan amendment is approved for the constriction of a continuing care retirement community with 314 independent apartments, 28 townhouses, and 92 beds for assisted living, memory care and skilled nursing care, according to the plans received by the City on August 28, 2008 and supplemental information received September 11, 18 and 22, except as amended by this resolution. 2. Approval of this PUD general plan is contingent upon City approval of the associated rezoning, preliminary plat and a revised wetland replacement plan. 3. Development standards shall be as indicated on the plans dated August 28, September 11, 18, and 22, 2008, except as amended by this resolution. 4. No building permits shall be issued until a PUD final plan is submitted to and approved by City staff. 5. As part of the materials submitted for the PUD final plan for Phase I, the applicant shall revise the plans consistent with the concept drawings dated September 23 and 25, 2008 showing 1) a revised location for the townhouses on the south side of the development and 2) the revised building elevations. 6. Prior to issuance of a building permit for the northernmost townhouse near CR 47, the applicant shall provide proof of ownership of Outlot I, Taryn Hills. 7. The following structural setbacks shall apply: a. The townhouses shall be set back 25 feet from the rights-of-way of 59th Avenue North, 57th Avenue North, existing County Road 47, and Cheshire Parkway and 50 feet from the realigned right-of-way of County Road 47. b. The main building housing the independent senior apartments, assisted living, dementia and skilled nursing care center, and the commons facilities shall be set back a minimum of 27 feet from all rights-of-way. c. A 15 -foot setback from the wetland buffers shall apply to all buildings, except that uncovered decks and at -grade uncovered patios may be located no closer than nine feet to the wetland buffer. d. A 16 -foot setback between the living spaces of townhouses. e. A 12 -foot setback between garages and covered stoops for the townhouses. Resolution 2008-313 File No. 2008085 Page 3 f. All townhouse driveways shall be 22 feet in length as measured from the face of the garages to the back of the curb. 8. The following shall not be considered encroachments into the required setbacks as long as they do not project more than four feet into the required setback: chimneys up to six feet in width, flues, leaders, sills, pilasters, lintels, ornamental features, cornices, eaves, gutters and the like. 9. The fiiture townhouse stricture shown closest to County Road 47 shall not be constricted until County Road 47 is realigned further north. The townhouse building shall be set back 50 feet from the realigned right-of-way and shall have a 22 -foot long driveway as measured between the face of the garage door and the back of the curb. 10. For the portion of the development within the Pomerleau and Camelot Shoreland Management Districts, impervious surface coverage shall be limited to a maximum of 25 percent of the total area, excluding the public rights-of-way. 11. Street light fixtures installed in public rights-of-way shall be consistent with those installed in The Reserve and Glacier Vista subdivisions. 12. Cheshire Parkway shall be landscaped consistent with the planting plans for The Reserve and Glacier Vista subdivisions and the landscaping in the boulevards and medians of Cheshire Parkway shall be irrigated. 13. Standard Conditions: a. All signage shall require separate permits and shall be in conformance with the requirement for residential districts as defined in the Zoning Ordinance, unless amended at a later date. b. The applicant shall be responsible for maintenance of the sidewalks, monument signs, boulevard and median plantings within the Cheshire Parkway right-of-way, wetland buffers and buffer monuments, and all other improvements on the subject property. c. A conservation easement shall be recorded against the property to protect the existing treed area on the west side of the project from any future development. This area shall be reserved for private active and passive open space uses (such as resident gardens, trails, a garden pavilion, etc.) that do not require tree disturbance or removal beyond that shown on the concept plans received by the City on September 23, 2008.
