HomeMy WebLinkAboutCity Council Resolution 2008-304CITY OF PLYMOUTH RESOLUTION NO. 2008-304 APPROVING AN ADDENDUM TO THE COOPERATIVE AGREEMENT WITH BASSETT CREEK WATERSHED MANAGEMENT COMMISSION WEST MEDICINE LAKE PARK POND IMPROVEMENTS CITY PROJECT NO. 3105 WHEREAS, a Cooperative Agreement has been prepared and approved by the Bassett Creek Watershed Management Commission (Commission) on April 19, 2007 with reference to the improvement of a detention pond in West Medicine Lake Park; and WHEREAS, the City Council approved the Cooperative Agreement with the Commission on May 8, 2007; and WHEREAS, the proposed improvement includes constriction of a detention pond upstream of the point where Plymouth Creek discharges into Medicine Lake, as identified in a preliminary engineering report prepared by Barr Engineering, dated May 2006; and WHEREAS, the Agreement provided that the City would enter into a contract for the constriction of the West Medicine Lake Park Pond Project and to be reimbursed by the Commission in an amount not to exceed $900,000; and WHEREAS, it has been determined that the estimated cost of the project and reimbursement should be increased to $1,100,000 to account for wetland mitigation expenses that were not included as a part of the original project cost estimate. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. The Council hereby approves the addendum to the Cooperative Agreement as presented and authorizes the Mayor and City Manager to execute the Agreement on behalf of the City. Adopted by the City Council on October 14, 2008.
