RESOLUTION NO. 2008-304
APPROVING AN ADDENDUM
TO THE COOPERATIVE AGREEMENT WITH
BASSETT CREEK WATERSHED MANAGEMENT COMMISSION
WEST MEDICINE LAKE PARK POND IMPROVEMENTS
CITY PROJECT NO. 3105
WHEREAS, a Cooperative Agreement has been prepared and approved by the Bassett
Creek Watershed Management Commission (Commission) on April 19, 2007 with
reference to the improvement of a detention pond in West Medicine Lake Park; and
WHEREAS, the City Council approved the Cooperative Agreement with the
Commission on May 8, 2007; and
WHEREAS, the proposed improvement includes constriction of a detention pond
upstream of the point where Plymouth Creek discharges into Medicine Lake, as identified
in a preliminary engineering report prepared by Barr Engineering, dated May 2006; and
WHEREAS, the Agreement provided that the City would enter into a contract for the
constriction of the West Medicine Lake Park Pond Project and to be reimbursed by the
Commission in an amount not to exceed $900,000; and
WHEREAS, it has been determined that the estimated cost of the project and
reimbursement should be increased to $1,100,000 to account for wetland mitigation
expenses that were not included as a part of the original project cost estimate.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. The Council hereby approves the addendum to the Cooperative
Agreement as presented and authorizes the Mayor and City Manager
to execute the Agreement on behalf of the City.
