HomeMy WebLinkAboutCity Council Resolution 2008-284CITY OF PLYMOUTH RESOLUTION 2008-284 DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED MAY 20, 2008 FOR THE PROPOSED WILD WINGS FLOOD IMPROVEMENT PROJECT CITY PROJECT NO. 7135 WHEREAS, the Planning Commission has reviewed the Environmental Assessment Worksheet (EAW) for the Wild Wings Flood Protection Project (7135) on July 16, 2008; and WHEREAS, pursuant to Minnesota Environmental Review Program riles, the City of Plymouth, acting as the responsible governmental unit, prepared and distributed an Environmental Assessment Worksheet (EAW) for the Wild Wings Flood Protection Project (7135)on June 16, 2008; and WHEREAS, the 30 -day review period expired on July 16, 2008, and all comments and recommendations received from reviewing agencies and other interested parties have been considered; and WHEREAS, the City Council granted an extention of 60 -days to gather information pertaining to comments received from the Minnesota Pollution Control Agency (MPCA) and the Minnesota Department of Natural Resources (MnDNR) based upon review of the EAW; and WHEREAS, the City will address the comments of the MPCA and the MnDNR by considering removal of the most westerly wetland from the project altogether, creating small sedimentation basins at discharge points, and continuting to implement best management practices such as street sweeping; and WHEREAS, it has been determined that the proposed project does not present a potential for environmental impacts of such significance that an Environmental Impact Statement would be required. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does make a Negative Declaration on the need for an Environmental Impact Statement (EIS) for the proposed project known as the Wild Wings Flood Protection Project (7135) based on the Record of Decision and subject to the following conditions: 1. Compliance with all statements in the attached Record of Decision. 2. Strict adherence to the City's Erosion Control Ordinance shall be met during constriction and until the site is re -vegetated.
