Adjournment NOTICE OF SPECIAL COUNCIL MEETING The Plymouth City Council will conduct a special council meeting on Tuesday, October 29, 1996, beginning at 5:30 p.m. in the Council Chambers, 3400 Plymouth Blvd. The purpose of the meeting will be to consider the proposed zoning ordinance amendments concerning RV parking, including draft ordinance sections 21105.11 and 21135.06. Johnson, City Manager SUBJECT: Summary of Events The BIG event of the week was the meeting on the zoning ordinance at Zachary Lane School Thursday night. Estimates range from 150 -250 in attendance. The big issue was the parking and storage of recreational vehicles. The audience was quite hostile, despite the fact that our planning staff announced at the beginning of the meeting that the RV regulations were slated to be removed from consideration before the Planning Commission hearing on November 12a`. The following are some actions Council members and staff have taken in response: 1. We will have plenty of flyers on the zoning and RV regulations at our open house on Saturday morning (10 a.m. to noon). Anne will be present to answer the public's questions on the zoning ordinance. 2. The City Council will hold a special meeting at 5:30 p.m. next Tuesday, October 29*, to direct staff and the Planning Commission to delete restrictions on parking and storage of RV's from the draft zoning regulations. This Council meeting will be in advance of the planned meeting at Parker's Lake at 7:00 p.m. that evening. The Council's action can then be announced at that meeting. 3. We are holding the presses on our November Plymouth News so that the Council's action on Tuesday night can be covered in it. Two pages are being reserved for it. 4. We will quickly report the Council's action through other media as well. 5. We will have at least one uniformed officer at the Parkers Lake meeting to help assure order. 6. We will do more to outline the positives of the zoning ordinance at the Parkers Lake meeting. 7. We are reviewing the entire ordinance to see if any similar hidden problems are present. We plan to have a list of changes, whether good or bad, or large or small, in residential requirements for you by the Tuesday evening meeting. With hindsight, it seems that we pushed the zoning ordinance forward too fast. We have been eager to put an end to moratoria actions, neighborhood conflicts, and procedural problems related to the old zoning ordinance. Our consultant wrote all the regulations. Many staff members, including me, met a number of times to screen them, amend them, or otherwise make them fit Plymouth. Unfortunately, the RV issue escaped our notice, so much so that we didn't even mention it at our Council briefing on the zoning ordinance. We do regret and apologize for the concern this has caused the Council and the community. PROPOSED MOTION: Adopt the attached resolution which a) directs the City staff and the Planning Commission to remove from the draft zoning ordinance language on pages 104 and 130, relating to parking and storage of recreational vehicles and equipment; and b) defers further discussion on this issue to the first City Council meeting in 1997 (January 8, 1997.) 2. STATEMENT OF THE PROBLEM, ISSUE OR PROJECT: The draft Zoning Ordinance contains several new provisions concerning the parking of recreational vehicles in residential districts. These provisions have proven to be very controversial, and staff has taken numerous phone calls protesting the proposed regulations. The Sun Sailor and local cable news have carried stories on the subject, and flyers urging opposition to the ordinance have been distributed throughout the community. These provisions were the major topic of discussion at the information meeting on the ordinance held on Thursday, October 24 at Zachary Lane Elementary School Based on this overwhelming citizen input, Community Development staff proposes that the Council direct that we delete language from the proposed zoning ordinance that would: limit the number of recreational vehicles; set a 72 -hour limit on storage; require that they be parked in a side or rear yard; and add screening requirements. The ordinance would state that recreational vehicles and equipment may be parked or stored on a residential site when used by the family residing in the dwelling, and that the equipment must have the registrations or licenses required by law. This would provide a tool by which the City could deal with inoperative or junk RV's, and with situations when someone is storing vehicles or equipment that belong to non-residents. This section has received support from residents in the meetings held to date. 3. RECOAC%IENDATION: I recommend that the Council a) direct the City staff and the Planning Commission to remove from the draft zoning ordinance language on pages 104 and 130, relating to parking and storage of recreational vehicles and equipment, as indicated by the stricken language shown on the pages attached; and b) defer further discussion on this issue to the first City Council meeting in 1997 (January 8, 1997.) DIRECTING THE STAFF AND THE PLANNING COMMISSION TO DELETE CERTAIN LANGUAGE RESTRICTING THE PARKING AND STORAGE OF RECREATIONAL VEHICLES FROM THE DRAFT ZONING ORDINANCE. Whereas, the draft of new zoning regulations contains new provisions that would unreasonably restrict the parking and storage of recreational vehicles; and, Whereas, there has been overwhelming public comment against these proposed regulations at two public information meetings held to date; and, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plymouth that: 1. That the staff and Planning Commission be directed to remove language restricting the parking and storage of recreational vehicles from pages 104 and 130 of the draft zoning regulations as shown on the attached pages. 2. That further discussion on this issue be deferred to the first City Council meeting in 1997. The cost of abatement shall be recovered in accordancewiththeapplicableprovisionsofSection2010oftheCityCode. Subd. 2. Residential Zoning Districts. a) Exceptions. All personal property shall be stored within a building or fullyscreenedsoasnottobevisiblefromadjoiningpropertiesandpublicstreets, except forthefollowing: 1) Play and recreational facilities. 2) Stacked firewood for the burning supply of the property resident. 3) Construction and landscaping materials or equipment, if these are usedorintendedforuseonthepremiseswithinaperiodoftwelve (12) months. 4) Agricultural equipment and materials, if these are used or intended for use on the premises within a period of twelve (12) months. 5) Off-street parking of licensed passenger automobiles and personal or commercial vehicles of less than twelve thousand (12,000) pounds gross weightindesignateddrivewayorparkingarea, surfaced in compliance with Section21135.07, Subd. 1. of this Chapter. b) Recreational Vehicle and Equipment Storage. Recreational vehicles, as defined by Section 21005 of this Chapter, may be parked or stored on aresidentialsitewhenusedbythefamilyresidinginthedwellingonsuchsite. Such vehicles or equipment shall have affixed thereto current registration or license plates as required by law and shall be stored so as to comply with accessory building setbackrequirementsoftheresidentialsectionofthisChapterandsuchparkingorstorageshall otherwise meet all other requirements of any other City ordinances and any state laws. No parked or stored vehicles or items shall be connected to any water or sewagedisposalsystemonsaidpropertywheresameissoparkedorstored. Subd. 3. Except where otherwise allowed as exterior storage or in a zoning district, trucks of more than twelve thousand (12,000) pounds in gross vehicle weight or greater than thirty (30) feet in length, and contracting or excavating equipment may not be parked; stored or otherwise located on any property within the City unless being used in conjunction with a temporary service benefiting the premises. Subd. 32. Junked or inoperable vehicles may not be parked, stored or otherwise located on any property within the City for a period greater than seventy-two (72) hours unless placed completely within an enclosed building or garage or screened in accordance with the provisions of Section 21130 of this Chapter. Said regulations shall also apply to race cars. Subd. 43. No motor vehicle repair work of any kind shall be permitted in conjunction with exposed off-street parking facilities, except for minor repairs of vehicles owned by the occupant or resident of the principal use for which the parking space is intended. No exterior storage of car parts are allowed at any time. 21135.07. PARKING AREA DESIGN: Subd. 1. Construction. a) Except in the FRD District, all exposed parking areas and driveways shall be surfaced with material such as asphalt or concrete. Equivalent surfacing materials and porous pavement options may be allowed upon approval by the Zoning Administrator. b) Except as may be required or exempted by the Zoning Administrator, drive aisles and parking stalls shall be constructed in accordance with the following minimum tonnage standards: 1) Drive aisles - seven (7) ton. 2) Parking stalls - five (5) ton. Subd. 2. Striping and Curbing. All parking areas where four (4) or more spaces ale required shall be marked by durable painted stripes designating the parking spaces.
