HomeMy WebLinkAboutCity Council Resolution 2008-258CITY OF PLYMOUTH RESOLUTION 2008-258 APPROVING A PLANNED UNIT DEVELOPMENT AMENDMENT AND PRELIMINARY PLAT FOR THE ROTTLUND COMPANY INC. FOR "THE RESERVE 3"" ADDITION" FOR PROPERTY LOCATED WEST OF CHESHIRE PARKWAY AND NORTH OF 55TH AVENUE NORTH (2008003) WHEREAS, The Rottlund Company Inc., has requested approval of a planned unit development amendment and preliminary plat to allow a subdivision of 17 single-family lots and one outlot on a 5.49 -acre site located west of Cheshire Parkway and north of 55"' Avenue North; and WHEREAS, the property is legally described as follows: Outlot A, The Reserve, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by The Rottlund Company Inc., for a planned unit development amendment and preliminary plat, subject to the following findings and conditions: 1. The PUD amendment and preliminary plat is approved in accordance with the application received by the City on January 10, 2008 and revised plans received by the City on August 19, 2008, except as may be amended by this Resolution. 2. This approval is contingent on approval of amended PUD ordinance. 3. Adjacent paved streets shall be kept free of mud, sand, and silt as a result of constriction. Resolution 2008-258 (2008003) Page 2 4. Watermain area charges are required based on 5.49 acres at $3,525.00 per acre equal to $19,352.25. The rate per acre is based on the water area charge for 2007, and is subject to a potential 2008 rate increase with the final plat/development contract. 5. Sanitary sewer area charges are required based on 5.49 acres at $950.00 per acre equal to $5,215.50. The rate per acre is based on the sanitary sewer area charge for 2007, and is subject to a potential 2008 rate increase with the final plat/development contract. 6. Access is prohibited to Cheshire Parkway. Private drive access is prohibited to Fernbrook Lane. 7. Floor elevations shall be a minimum of two feet higher than the 100 -year high water elevation for adjacent rain gardens. In addition, there must be a minimum of 18 inches of vertical freeboard from the lowest building opening where storm water can enter (door or window) and the emergency overland overflow route. 8. The applicant shall provide a pedestrian ramp to the sidewalk at the Fernbrook Lane and 55", Place North intersection. 9. Side yard setbacks for the development shall be eight feet to living space and six feet to garage space 10. Impervious surface area coverage for the development shall not exceed 25 percent. 11. In conjunction with submittal of the PUD final plan and final plat application, the applicant shall address the following: a. Submit Home Owners Association documents. The documents shall include the creation of fiinds to address snow removal and the continued maintenance of required stormwater treatment systems and the center island. The Homeowners Association shall also be responsible for the maintenance of the sidewalk along Fernbrook Lane. b. Revise plans identifying the density of the development as three units per acre. C. Submit a sign plan for any development signage on the property. Any signage shall be designed to be consistent with the signage in The Reserve development. d. Submit a lighting fixture plan for the street lights to be consistent with street lighting for The Reserve development. e. Provide a 10 -foot drainage and utility easement adjacent to all public streets. Provide a six-foot drainage and utility easement along rear lot lines. The standard six-foot side yard drainage and utility easement is not required. Revise the preliminary plat and the detail to address this requirement. Retaining walls are not allowed in drainage and utility easements. f. Provide a 20 -foot drainage and utility easement (10 feet on each side of the pipe) for all public utilities that are not located in a public street right-of-way. Resolution 2008-258 (2008003) Page 3 g. Provide a drainage and utility easement up to the 100 -year high water elevation for the rain garden located in the rear yard of Lot 9, Block 1. Provide a drainage and utility easement up to the 1024.5 elevation for ponding storm water near the storm sewer manhole in the rear yard of Lot 1, Block 1. h. Provide a rain garden maintenance agreement for both rain gardens. i. Provide an encroachment agreement for all retaining walls located within a drainage and utility easement. j. Include the City of Plymouth's Engineering Guidelines/Standard Specifications in the development contract documents. k. A separate plan and profile sheet is required for the sanitary sewer, water, storm sewer, and streets with the final plat application. Include a street signage and lighting plan (may be on the plan sheet). 1. A storm sewer stricture/casting table is required. Include elevations, type of stricture, and casting types with approved numbers. M. Identify sanitary sewer and water service size, elevation, material type and stationing. n. A Major underground utility line is located along the west side of the project. This line is Monitored with compressed air. Both horizontal and vertical location of this line is necessary to avoid potential constriction conflicts with proposed street access and utility connections. Field verify the private utilities. o. Written approval is required from the private utilities to allow the street and all public utilities to cross or be located in the private easement. p. No constriction parking on Fernbrook Lane is allowed. Access and constriction parking May be allowed on the boulevard of Cheshire Lane, provided this project is constricted before Cheshire Lane is extended. Any damaged curb or bituminous shall be replaced. Place this note on the plans. q. The center island of the public street shall be public street right-of-way. Maintenance of the island will be the responsibility of the Home Owners Association for the subdivision. The pavement width between the outside curb of the turn -around and the island shall be a minimum of 28 feet. r. On street parking may be allowed around the cul-de-sac provided it does not interfere with fire trick turning radius requirements as approved by the Fire Inspector. S. Street lights are required at the intersection of Fernbrook Lane and 55t11 Place as well as a minimum of one light at the end of 55'11 Place cul-de-sac. t. A wet tap connection for the watermain is required in Fernbrook Lane. U. No inside drop into the sanitary sewer Manhole in Fernbrook Lane is allowed. V. Repair of Fernbrook Lane for the utility connections must be completed within 24 hours. Full reconstruction of Fernbrook Lane (curb and gutter, sand, rock and bituminous as appropriate) is required for the disturbed area. The road must be repaired within 48 hours from Making the utility cut. Show the limits of the disturbed area on the plans. Closure notification is required one week in advance. No overnight closure is allowed. Add these notes to the plans. W. Show drain the locations for the street on the final plans. Reference City detail ST -9, and include detail. Resolution 2008-258 (2008003) Page 4 X. Modified city details are not allowed. Replace the street and trail section details with city detail STRT-2 and STRT- 4. y. Show the locations of catch basin inlet erosion control protection. Include city details ST -22 and 23. Show the location of the concrete wash out area. Z. Erosion control blanket is required on slopes 3:1 or greater. aa. Clearly indicate the locations for the soil compost amendment (as indicated in the drainage calculations) on the plans. bb. Include all appropriate details using current (March 2008) unmodified City Standard details. cc. All main line storm sewers (12 -inches in diameter or larger) shall be video inspected, and a CD shall be provided to the City. Place this note on the plan. dd. High density polyethylene extruded (HDPE) adjusting rings are required for all strictures. Add this note to the plans. ee. The City requires all below grade nuts and bolts to comply with the American Society for Testing and Materials (ASTM) F593 Type 316 stainless steel for all fittings, hydrants and gate valves. Refer to City Specifications. This may be a special order for the hydrants and gate valves. Place this note on the plan. ff. Compression fitting required for all copper services. Refer to City Specifications. Place this note on the plan. gg. Cast iron yellow coated truncated dome panels shall be used for pedestrian ramps. Provide City detail STRT-6 and indicate placement of the pedestrian ramp at 55t1i Place along Fernbrook Lane. hh. The rain garden management plan maintenance will need to be specified for the five year period after complete vegetative stabilization for the entire -1 Addition. Annual documentation of the rain gardens must be submitted to the City for a five year period. ii. Provide a detail for the curb cuts around the center island for the rain garden in the cul- de-sac. Provide a drainage -way for the storm water to drain into the rain garden without causing erosion problems. jj. Revise the final plat to reflect street right-of-way in the center island of 55t11 Place North. It should not be labeled Outlot A. kk. The City's current Comprehensive Plan (2000) requires that a booster pump be installed for buildings with a ground elevation of 1015 or higher. ll. The existing dead end fire hydrant on the south side of the plat shall be salvaged for later city pick-up. mm. The rear yard grade on Lots 11 and 12 is too flat. (Minimum grade of 1.75 percent is required). Install storm sewer or drain tile into the storm sewer manhole along the lot line of Lots 12 and 13 or adjust grades to meet the minimum standard. nn. Add a note to core drill the drain tile connections to all storm sewer strictures. oo. Submit turning radius evaluations for Plymouth Fire apparatus A21, E21, TOWER 11, and LADDER 31. The evaluation must include all proposed street parking spaces. The turning radius paths for all apparatus must ensure that the apparatus do not extend into parking spaces, come in contact with any objects or extend past the face of all curbs. Resolution 2008-258 (2008003) Page 5 12. Prior to release of the final plat for recording, the following items shall be addressed: a. The applicant shall execute a Development Contract for the public and private improvements, and shall submit the required financial guarantees. b. The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time of filing of the final plat. c. A maintenance agreement is required for all rain gardens. 13. A 2radin2 permit is required prior to any excavation or trading on the site. Approval of the site grading and excavation for each lot may also be approved with building permit issuance. 14. Separate building permits and retaining wall permits shall be obtained prior to any construction on the site. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. Any retaining wall exceeding four feet shall be engineered and shall have a minimum three-foot high fence on top of the wall. 15. Prior to issuance of any grading or building permits: a. Impervious surface calculations shall be identified on a certified survey for each lot. b. Silt fence shall be installed on the property. c. The applicant shall obtain all necessary permits from the: 1) MPCA for sanitary sewer extension and NPDES, 2) MCES for sanitary sewer connections, 3) Minnesota Department of Health for the watermain, and 4) Shingle Creek Watershed District. 16. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. This approval shall expire one year after the date of approval, unless the property owner or applicant has submitted a complete application for approval of a final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of City Code. c. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
