HomeMy WebLinkAboutCity Council Resolution 2008-251CITY OF PLYMOUTH RESOLUTION 2008-251 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR U.S. HOME CORPORATION FOR "TARYN HILLS 8"' ADDITION" FOR PROPERTY LOCATED SOUTHEAST OF COUNTY ROAD 47 AND VICKSBURG LANE (2008058) WHEREAS, U.S. Home Corporation has requested approval of a final plat for 47 multi -family lots and 15 outlots on 9.33 acres of land located southeast of County Road 47 and Vicksburg Lane in the "Taryn Hills" plat; and WHEREAS, the property is presently legally described as follows: Outlot J, Taryn Hills 7t1' Addition, Hennepin County, Minnesota, according to the recorded plat thereof. E Outlot D, Taryn Hills 5t1' Addition, Hennepin County, Minnesota, according to the recorded plat thereof. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by U.S. Home Corporation for a final plat for Taryn Hills 8t1' Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The plat is approved in accordance with the plans received by the City on July 3, 2008, except as may be amended by this resolution. Resolution 2008-251 File 2008058 Page 2 2. Development standards shall be as required by the RMF -3 district. No variances are granted or implied. 3. The developer must obtain a sign permit from the City Building Official prior to installation of subdivision identification signs. 4. The developer shall notify potential buyers about future roadway expansion and improvement projects for County Road 47 and Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway projects. 5. Compliance with the City's tree preservation regulations, in accordance with the approved preliminary plat. 6. The applicant shall obtain the necessary permits and approvals or verify that previous approvals are valid as follows: Minnesota Pollution Control Agency, Elm Creek Watershed District and NPDES. 7. Prior to recording the final plat, the following items shall be addressed and/or the final plat and plans shall be revised as follows: a. The applicant shall execute a Development Contract for the public and private improvements, and shall submit the required financial guarantees. b. The required park dedication fee shall be paid, in accordance with the dedication ordinance in effect at the time the final plat is recorded. c. The following area and deferred assessments shall be paid: 1) Watermain area charges based on 7.32 acres at $3,525 per acre = $25,803.00. 2) Sanitary sewer area charges based on 7.32 acres at $950 per acre = $6,954.00. d. Add a note to the plans stating "The Contractor shall contact Sewer and Water Department at 763-509-5950 a minimum of 48 hours prior to any public sewer/watermain connection." e. The Homeowner's Association documents shall include language ensuring HOA maintenance of the association common spaces including sidewalks, landscaped medians, and similar features, and prohibiting storage in the parking spaces of the multi -family areas—including storage of recreational vehicles. f. Plans shall comply with the City of Plymouth's current Engineering Guidelines/Standard Specifications or the State Plumbing Code, whichever applies. g. Provide a grading plan for this phase of constriction. h. In conjunction with recording of the final plat, the developer shall provide a ten -foot wide trail easement on lots and outlots abutting County Road 47 within the plat. i. All retaining walls over four feet high must be engineered walls, and a separate building permit will be required. Resolution 2008-251 File 2008058 Page 3 j. Retaining walls shall not be located within drainage and utility easements or within the right-of-way. k. Concrete aprons as shown on City detail STRT-13 shall be installed for the private drives on 60"' Avenue for Outlots A (two aprons), Outlot M and Outlot O. 1. "No Parking" signs shall be installed on both sides of all private drives per the direction of the Fire Inspector. m. Add note 19 on page 4 to read "HDPE adjusting rings shall be used on all manholes and catch basins." n. Add note 20 on page 4 to read "All below grade bolts, T -bolts, nuts and rodding shall be ASTM F 593 type 316. This applies to all fittings, gate valves, and hydrants." o. On page 6, revise note number 3 to tie the last 6 pipe joints, instead of 4 as shown. p. On page 6, revise note number 8. Remove the wording "igneous or metamorphic rock." Rip rap shall be Granite. q. On page 6, add note number 10 to read "HDPE rings shall be used on all manholes and catch basins." r. B618 concrete curb and gutter is required on all private drives. s. Remove the surmountable curb installed on the east side of 60"' Avenue south of Lot 4, Block 10 Taryn Hills 5"' Addition (by the model parking lot), and install B618 concrete curb and gutter. t. The sanitary sewer, storm sewer, and water main are "public" utilities. The drives (excluding 60"' Avenue) are "private" and shall be maintained by the Homeowners Association. Indicate what is "Public" and what is "Private" on the constriction drawings. Reference the maintenance responsibilities of the private drives in the Home Owners Association documents. 8. Prior to issuance of building permits permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 9. Prior to issuing certificates of occupancy, the developer shall install unit address/ directional signage on the private drives where they intersect with public roadways. 10. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Street names shall comply with the City's street naming system. c. Removal of all hazardous trees from the property at the owner's expense. d. The lowest floor elevation must be a minimum of two feet above adjacent water bodies. In addition, there must a minimum of 18 inches of freeboard between the lowest building opening where storm water may enter (doors or window) and the designated emergency overland overflow. e. The multi -family strictures shall be protected by a City approved automatic fire sprinkler system. Resolution 2008-251 File 2008058 Page 4 f. The development shall comply with the Ordinance regarding turning radius, fire lane constriction, location of fire hydrants, lock boxes, post -indicator valves, fire department connections, and fire lane signage. g. All street water mains shall be looped, and the water main system shall be looped for all cul-de-sac streets that exceed 500 feet in length. h. A reproducible 8 '/z x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any financial guarantees. i. A reproducible mylar print and electronic file format (AutoCad DWG file format) of sanitary sewer, water service, storm sewer and pond As-Builts for the site shall be submitted prior to the release of any financial guarantees. j. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. k. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
