HomeMy WebLinkAboutCity Council Resolution 2008-246CITY OF PLYMOUTH RESOLUTION 2008-246 APPROVING AN INTERIM USE PERMIT FOR QUANTUM DEVELOPMENT FOR THE PROPERTY LOCATED AT 12325 STATE HIGHWAY 55 (2008052) WIffiREAS, Quantum Development, Inc. has requested approval of an interim use permit to allow a temporary classroom building located at 12325 State Highway; and WIffiREAS; the subject property is legally described as follows: All that part of the North One Half of the Northwest Quarter of Section 35, together with all that part of the South One Half of the Southwest Quarter of Section 26, Township 118, Range 22, Hennepin County, Minnesota lying South and Southwesterly of the Southerly right of way line of County Road Number 6 and South and Southwesterly of the Southerly right of way line of State Think Highway Number 55 described as follows. Beginning at the point of intersection of the Southwesterly right of way line of County Road No. 6 and the South line of said Section 26; thence Northwesterly along said Southwesterly right of way line 496.62 feet; thence Southwesterly at right angles with said Southwesterly right of way line 614.03 feet; thence Southeasterly at right angles 296.94 feet; thence Northeasterly at right angles 300 feet to the South line of said Section 26; thence East along the South feet to the South line of said Section 26; thence East along the South line of Section 26 372.14 feet more or less to the point of beginning. Also That part of Lot 1, Block 5, BEACON HEIGHTS FIRST ADDITION, Hennepin County, Minnesota which lies Northwest of a line running from a point the northeasterly line of said Lot 1, distant 5.50 feet southeasterly from the northeast corner thereof to a point in the southwesterly line of said Lot 1, distant 175.00 feet southeasterly from the northwest corner thereof. Resolution 2008-246 Page 2 (2008052) WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Quantum Development, Inc. for an interim use permit, subject to the following findings and conditions: An interim use permit to allow a slightly less than 2,000 -square foot temporary classroom building is approved, in accordance with the application materials received by the City on June 12, 2008, and revised plans received by the City on July 3, 2008 and July 8, 2008, except as amended by this resolution. 2. The interim use permit is approved with the finding that all applicable interim use permit standards are met, as follows: a. The interim use permit request for a detached classroom building would comply with all of the conditional use permit standards in Section 21015.02, Subd. 5 of the Zoning Ordinance and the general performance standards in Section 21015.04 of the Zoning Ordinance. The RSF-I zoning district states that an interim use permit may be granted for a temporary classroom building. b. The interim use permit would not impose additional public costs. Separate building permits are required prior to construction of the temporary classroom building. 4. The applicant shall construct the parking expansion prior to commencing use of the classroom building. The temporary classroom building shall be removed from the site within three years from the date of this approval or when the building is vacant for six months, whichever occurs first. In addition, this interim use permit approval shall terminate on July 1, 2009 if construction of the 10,378 -square foot building addition has not begun. 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 7. This permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation.
