HomeMy WebLinkAboutCity Council Resolution 2008-245CITY OF PLYMOUTH RESOLUTION 2008-245 APPROVING A SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT AMENDMENT FOR QUANTUM DEVELOPMENT FOR THE PROPERTY LOCATED AT 12325 STATE HIGHWAY 55 (2008052) WIffiREAS, Quantum Development, has requested approval of a site plan amendment and conditional use permit amendment for a building addition and parking expansion, for property legally described as: All that part of the North One Half of the Northwest Quarter of Section 35, together with all that part of the South One Half of the Southwest Quarter of Section 26, Township 118, Range 22, Hennepin County, Minnesota lying South and Southwesterly of the Southerly right of way line of County Road Number 6 and South and Southwesterly of the Southerly right of way line of State Think Highway Number 55 described as follows. Beginning at the point of intersection of the Southwesterly right of way line of County Road No. 6 and the South line of said Section 26; thence Northwesterly along said Southwesterly right of way line 496.62 feet; thence Southwesterly at right angles with said Southwesterly right of way line 614.03 feet; thence Southeasterly at right angles 296.94 feet; thence Northeasterly at right angles 300 feet to the South line of said Section 26; thence East along the South feet to the South line of said Section 26; thence East along the South line of Section 26 372.14 feet more or less to the point of beginning. Also That part of Lot 1, Block 5, BEACON HEIGHTS FIRST ADDITION, Hennepin County, Minnesota which lies Northwest of a line running from a point the northeasterly line of said Lot 1, distant 5.50 feet southeasterly from the northeast corner thereof to a point in the southwesterly line of said Lot 1, distant 175.00 feet southeasterly from the northwest corner thereof. Resolution 2008-245 File No. 2008052 Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Quantum Development for a site plan amendment and conditional use permit amendment for a building addition and parking expansion, subject to the following conditions: I. A site plan amendment to allow a 10,378 -square foot building addition and parking expansion and a conditional use permit amendment to allow a K-8 and private day care/ nursery school to operate from the facility as well as to allow for the use of the gymnasium and storage space by Wayzata Public Schools are approved in accordance with the application materials received by the City on June 12, 2008, and revised plans received by the City on July 3, 2008, July 7, 2008, and July 9, 2008, except as amended by this resolution. 2. The conditional use permit amendment is approved with the finding that all applicable conditional use permit standards are met, as follows: a. The proposed school use is consistent with the P -I guiding classification of the City's Comprehensive Plan as a use compatible with public uses. b. The school addition and parking expansion would not be injurious to the use and enjoyment of immediately surrounding properties nor would it diminish and impair property values within the neighborhood. The building addition, parking expansion, and temporary classroom would be screened from neighboring properties. c. The subject site is adequately served by public facilities. d. Educational facilities are a conditional use in the residential zoning districts. The proposed use would comply with the regulations of the RSF-I zoning district. Adequate parking would be available to allow expansion of the use. 3. The site shall be maintained in a sanitary manner. 4. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 5. Hours of operation shall be limited to; a. K-8 — 8:00 a.m. to 5:00 p.m. week days with extended hours for indoor extracurricular activities only. b. Gymnasium and Storage Space — 8:00 a.m. to 10:00 p.m., daily. c. Day Care/Nursery School — 6:00 a.m. to 6:00 p.m. week days. 6. Separate building permits are required prior to commencement of the proiect. 7. Prior to issuance of any building permits, the applicant shall: a. Submit a parking and traffic management plan for review and approval by City staff Resolution 2008-245 File No. 2008052 Page 3 b. Complete a site improvement performance agreement and submit a financial guarantee pursuant to Section 21045.10 of the Zoning Ordinance. c. Revise plans to identify "one-way/do not enter" signs in approved locations. d. Provide a compost, sand filter, or other best management practices on the south side of the parking lot to provide rate control. e. Obtain all appropriate permits from the Bassett Creek Watershed District and MnDOT for storm water drainage discharge. f. Revise plans C-3.01 and C-3.02 showing silt fence locations. g. Identify B612 curb and gutter for the parking lot, except for the curb cuts and surmountable curb discharge as shown on the plan. h. Revise plans to show contours of all berm areas. Calculate the cubic yards of excess soil that will be used to create the proposed berms and show them on the plans. Show existing contours a minimum of 100 feet beyond the property line. i. Revise plans to identify the berm out of existing side -yard drainage and utility easement per Document 5880337. j. Additional riprap or other approved permanent erosion control material is required for the parking lot curb cuts. Identify this on the plan. k. Revise plans to identify that the majority of drainage from area of constriction flows to the south. 1. Submit turning radius evaluations from all directions on the south parking lot/drive aisle system. The evaluation must include all Fire Department apparatus and must prove that the apparatus do not come in contact with any objects, extend into parking spaces or extend over the face of any curbs. m. Identify the water main size, location and hydrant locations on each phase. n. Submit fire flow calculations flowing the remote two highest elevation hydrants on the south side of the building simultaneously. Each hydrant must flow a minimum 1500GPM at 20 PSI residual pressure. o. Fire lane signs are required in approved locations including at the Fire Department connection location. The fire inspector will identify the locations on the site plan. p. Building additions and new buildings that are 2000-sqare feet and larger in total floor area must be protected by a city approved fire sprinkler system. 8. Record drawings are required consistent with the Engineering Guidelines, including berms. 9. No variances from any City ordinances or code standards regarding this use are granted or implied by this action. 10. All waste and waste containers shall be stored within approved designated areas. 11. New signage shall receive sign permits when required and shall comply with the Section 21155 of the Zoning Ordinance. 12. Compliance with all state educational facility requirements, as well as City zoning and building code requirements. Resolution 2008-245 File No. 2008052 Page 4 13. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 14. This approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 15. This conditional use permit shall automatically renew and be transferable in accordance with Minnesota State Statutes 462.3595. 16. This conditional use permit replaces the previous conditional use permit approved under Resolution 2005-296. 17. This approval shall expire three years after the date of approval, unless the property owner or applicant has started the project, or unless the landowner or applicant has received prior approval from the City Council to extend the expiration date.
