HomeMy WebLinkAboutCity Council Resolution 2008-243CITY OF PLYMOUTH RESOLUTION 2008-243 APPROVING AN EXTENSION FOR THE DECISION ON A NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) FOR THE PROPOSED WILD WINGS FLOOD PROTECTION PROJECT CITY PROJECT NO. 7135 WHEREAS, pursuant to Minnesota Environmental Review Program riles, the City of Plymouth, acting as the responsible governmental unit (RGU), prepared and distributed an Environmental Assessment Worksheet (EAW) for the Wild Wings Flood Protection Project (7135) on June 16, 2008; and, WHEREAS, the Planning Commission has reviewed the Environmental Assessment Worksheet (EAW) for the Wild Wings Flood Protection Project (7135) and conducted a public hearing on July 16, 2008; and, WHEREAS, the 30 -day public comment period expired on July 16, 2008, and written comments were received from the Minnesota Pollution Control Agency (MPCA), Metropolitan Council, and the Minnesota Department of Natural Resources (MnDNR); and, WHEREAS, the City has received comments from the MPCA that require fiirther investigation prior to consideration on the need for an Environmental Impact Statement (EIS); and WHEREAS, pursuant to Minnesota Rule 4410.17 Subp. 2a (B), the RGU may "postpone the decision on the need for an EIS, for not more than 30 days or such other period of time as agreed upon by the RGU and proposer, in order to obtain the lacking information"; and WHEREAS, the City, acting as both applicant and RGU, requests an extension of 60 days to gather information pertaining to comments from the MPCA and the MnDNR; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that an extension of 60 days to gather information pertaining to comments from the MPCA and the MnDNR is hereby granted.
