RESOLUTION NO. 2008-242
APPROVE CHANGE ORDER NO. 7 AND PAYMENT NO. 2090-20
AND FINAL FOR THE PUBLIC SAFETY / CITY HALL
EXPANSION AND REMODELING PROJECT
CITY PROJECT NO. 3134
WI-1EREAS, the original contract for the Public Safety/ City Hall Expansion and
Remodeling Project was awarded to Maertens-Brenny Constriction Company in the amount
of $8,469,150.00; and;
WIffiREAS, Change Order No. 1, adopted by the City Council on February 22, 2005,
modified that contract by increasing the contract by $48,164.00 to $8,517,314.00; and
WIffiREAS, Change Order No. 2, adopted by the City Council on March 29, 2005, modified
that contract by increasing the contract by $22,509.00 to $8,539,823.00; and
WIffiREAS, Change Order No. 3, adopted by the City Council on August 23, 2005,
modified that contract by increasing the contract by $46,381.00 to $8,586,204.00; and
WIffiREAS, Change Order No. 4, adopted by the City Council on November 8, 2005,
modified that contract by increasing the contract by $136,253.00 to $8,722,457.00; and
WIffiREAS, Change Order No. 5, adopted by the City Council on March 14, 2006,
increased the contract amount by $158,199.00 to $8,883,018.87; and
WIffiREAS, Change Order No. 6, adopted by the City Council on March 14, 2006,
increased the contract amount by $102,695.00 to $8,985,713.87; and
WIffiREAS, Change Order No. 7 would increase the contract by $19,178.50 to
$9,004,892.37; and
WIffiREAS, the City's owner's representative, has recommended approval of Change Order
No. 7; and
WIffiREAS, City Staff has reviewed and also recommends approval of Change Order No. 7
on the Public Safety / City Hall Expansion and Remodel Project; and
WIffiREAS, the City's owner's representative has certified acceptance of the work under
the contract with Maertens-Brenny Constriction Company and recommends approval of the
final request for payment; and

WHEREAS, the total project cost of $10,858,751.10 exceeds the amount approved by the
City Council of $10,850,000.00 by $8,751.10.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA:
1. That the City Council adopt the resolution approving Change Order No. 7 on the
Public Safety / City Hall Expansion and Remodel Project to increase the contract
amount by a total of $19,178.50.
2. That the original contract amount was $8,469,150.00 revised contract amount
of $9,004,892.37 and the value of the work to date is $9,004,892.37 and is
herewith approved.
3. That the work performed by the contractor for the Public Safety / City Hall
Expansion and Remodel Project and certified to the City Council by the
owner's representative as acceptable, being the same, is hereby released from
the contract except as to the conditions of the performance bond, any and all
legal rights of the owner, required guarantees and correction of faulty work
after final payment.
4. Request for Payment No. 2090-20 and Final in the amount of $19,178.50 to
Maertens-Brenny Constriction Company for the Public Safety / City Hall
Expansion and Remodel Project is hereby approved and the City Finance
Director is hereby authorized and directed to pay the same forthwith.
5. Interest from the bond proceeds are adequate to cover the additional
$8,751.10 project costs.
