RESOLUTION 2008-148
APPROVING AN AMENDMENT TO THE SITE PLAN AND CONDITIONAL USE PERMIT
FOR PROVIDENCE ACADEMY LOCATED AT 15100 SCHMIDT LAKE ROAD (2008011)
WHEREAS, Providence Academy has requested approval of an amendment to the site plan and
conditional use permit for property legally described as Lot 1, Block 1, Providence Academy;
and
WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Providence Academy for an amendment to the site plan and conditional use permit for property
located at 15100 Schmidt Lake Road, subject to the following conditions:
1. An amendment to the site plan and conditional use permit is hereby approved, in accordance
with the application and plans received by the City on February 15, 2008 and revised
landscape plan received by the City on March 26, 2008, except as may be amended by this
resolution.
2. Compliance with the conditions established in Resolution 99-478 which approved the
original site plan, conditional use permit, and variances for this site, except as may be
amended by this resolution.
3. Compliance with the conditions established in Resolution 2005-004 which amended the site
plan and conditional use permit, except as may be amended by this resolution.
4. The amended site plan and conditional use permit allows up to 313,000 square feet of floor
area for the facility, and up to 1,220 students to be served by the school.

5. Prior to issuance of building permits for Phase 3 constriction (northeast classroom addition),
the applicant shall submit a revised lighting plan that complies with Section 21105.06 of the
Zoning Ordinance including, but not limited to, compliance with the 25 foot mounting height
regulation for new fixtures, house side shielding requirements for new fixtures within 300
feet of residential property, and the allowable wattage regulations.
6. In conjunction with Phase 3 (northeast classroom addition), the applicant shall install 75
trees, as shown on the revised landscaping plan received on March 26, 2008. Additional
trees shall be required in the future with subsequent phases of constriction.
7. The seasonal dome over the two easternmost tennis courts shall be removed during the
warmer months (roughly May through October).
8. Any portable toilets placed in the area of the soccer fields, tennis courts, or football
field/track shall be screened from views from the north, south, and west.
9. The applicant must obtain the appropriate permits from the Building Division prior to
commencement of the project.
10. Prior to issuance of building permits for Phase 3 constriction, plans shall be revised or items
shall be provided as follows:
a. An access easement for maintenance is required for the inlet and outlet stricture of pond
SC-P6A. An access easement is also required around the north side of the relocated
football field/track to allow maintenance of the storm sewer control stricture and existing
watermain between Lots 7 and 8 of Silverthorne SthAddition. The access must originate
from Schmidt Lake Road, must be at least 15 feet wide (unobstructed) with a 12 foot
wide driving surface. The maximum grade shall not exceed ten percent vertical and three
percent horizontal.
b. A drainage and utility easement is required up to the 100 -year high water elevation for
the redesigned pond SC-P6A.
c. The applicant shall submit a separate request and provide the required $450 fee to vacate
certain existing drainage and utility easements and certain existing access easement areas
that would no longer be necessary. A separate City Council approval is required for the
vacation of easements. An overall diagram shall be submitted showing the drainage and
utility easements and access easement areas to be vacated, together with new easements
to be dedicated.
d. A rain garden maintenance agreement shall be required.
e. The follow permits or approvals shall be obtained: MPCA for sanitary sewer, Minnesota
Department of Health for watermain, Shingle Creek Watershed District, and NPDES.
f. Indicate B612 curb and gutter for the parking lot and drive aisles.
g. Floor elevations shall be a minimum of 18 inches above the lowest building opening
where storm water can enter (door or window). Provide the emergency overland storm
water route and elevation on the grading plan.

h. Add a note to the plans stating "The Contractor shall contact Sewer and Water
Department at 763-509-5950 a minimum of 48 hours prior to any public sewer/watermain
connection."
i. The site plan shall comply with the City of Plymouth's current Engineering
Guidelines/Standard Specifications or the State Plumbing Code, whichever applies.
j. Include the City of Plymouth Engineering Guidelines and Standard Detail Specifications
in the contract documents.
k. Include all appropriate details using current, unmodified City Standard details dated
March, 2008.
1. Add a note to the plans stating "All storm sewers shall be inspected by the Engineering
Division—call (763) 509-5500 a minimum of 48 hours in advance to schedule an
inspection."
m. Add a note to the plans stating "All main line storm sewers (12 inch diameter and larger)
shall be video inspected, and a CD shall be provided to the City."
n. Add a note to the plans stating "High density polyethylene extruded (HDPE) adjusting
rings are required for all strictures".
o. All rip -rap shall be granite, and shall have filter fabric placed below the rock. Provide
City detail ST -3.
p. No trash guards shall be installed on storm sewer flared end sections (FES) smaller than
24 inches in diameter. Revise plans accordingly.
q. Add a note to the plans stating "The City requires all below grade nuts and bolts to
comply with the American Society for Testing and Materials (ASTM) F593 Type 316
stainless steel for all fittings, hydrants and gate valves—this may be a special order for
the hydrants and gate valves."
r. Add a note to the plans stating "Compression fittings are required for copper services
refer to City Specifications."
s. Cast iron yellow coated truncated dome panels shall be used for all pedestrian ramps.
Place this note on the plans and include City detail STRT-6 and/or STRT-7.
t. Watermain shall be C900 or C905 PVC pipe.
u. A concrete drive apron is required for the exit from the new parking lot onto Schmidt
Lake Road. Provide City detail STRT-14. The exit lane shall be tightened to prevent left
turns, and the maximum grade shall not exceed three percent for 30 feet from Schmidt
Lake Road.
v. Parking lot drive aisles shall not exceed a grade of five percent.
w. All civil sheets shall be 22" x 34" or 24" x 36" with a horizontal scale of 1 inch = 50 feet
and a vertical scale of 1 inch = 10 feet. The approved plans for constriction purposes and
record drawings shall be the required size.
x. All abandoned utility lines shall either be removed or blown fill of sand and capped.
Indicate how each pipe run will be handled.
y. No inside drop is allowed for the sanitary sewer manholes.
z. On the Utility Plan on sheet C7 in the storm sewer stricture schedule, remove casting R
2501 and replace with R 2573. Also add catch basin manhole 6A thri 11.
aa. Remove trash guards from storm sewer pipe smaller than 24 inches in diameter—refers
to the bio -retention pond (rain garden) on sheet C7.

bb. Remove the storm sewer apron on the pipe outlet for the pond in the northeast corner of
the project.
cc. Install drain tile 1/3 the length of the bio -retention pond (rain garden) and connect into
the outlet manhole at the invert elevation. Consider if compost and native seed will work
in lieu of the rain garden for the drainage area that the rain garden treats.
dd. Replace pavement section detail specifications on sheet C8 with specifications per City
detail STRT-2.
ee. Identify seed and erosion control blanket for the south side of the relocated football
field/track, and all other slopes that are 3 to I or greater.
ff. Indicate the constriction access location and the designated location of the concrete trick
wash-out area on the storm water pollution prevention plan (SWPPP).
gg. Identify the overflow elevation and elevation for the pond and rain garden.
hh. Add a note to the plans stating "Conductivity and pressure testing of the watermain, as
well as testing for bacteria and disinfection, is required per City Specifications."
ii. Indicate the maintenance access routes on the Grading Plan.
jj. Revise storm water management notes as follows: 1) The time of concentration (Tc)
shall not exceed 20 minutes (not 30 minutes as presently shown) for Subcatchment 600
and 660; 2) the hydrological soils group (HGS) shall be type "C" (not type B or B/C as
presently shown); 3) under pond summaries, the bottom elevation of 889.0 for Pond 660
appears incorrect—please review and correct if needed; 4) the period length for the
assumed export factors shall be at least one year (not 0.5 years as presently shown).
Revise calculations and resubmit for review.
kk. Retaining walls four feet or higher must be engineered by a professional engineer and
require a separate building permit. Additionally, retaining walls four feet or higher must
include a fence at the top of the wall.
11. Revise the Landscaping Plan to remove plantings from the required unobstructed
maintenance accesses, as identified in 7.a. above.
11. The City of Plymouth Engineering Department will require a permit for work within the
street right-of-way prior to installation of the right -out only access point shown along
Schmidt Lake Road.
12. Relocate the hydrant on the northeast corner of the proposed classroom addition and the
southwest corner of the proposed auditorium addition to approved locations.
13. Fire lane signage is required in approved locations on all drive aisles and fire lanes.
14. Fire access, water supply, and location for the seasonal tennis dome must be in compliance
with the State Fire Code requirements for membrane strictures.
15. An accessible route is required between the school building, soccer fields, tennis courts, and
football field/track.

16. Six handicap stalls are required for the new south parking area, one handicap stall is required
for the parking area near the tennis courts, and one handicap stall is required for the parking
area east of the stadium.
17. The lower level elevator lobby in the auditorium addition must exit the building without
going through a storage area.
18. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
19. The approval is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
20. Standard Conditions:
a. This approval shall expire eight (8) years after the date of approval.
b. The applicant shall comply with the ordinance regarding the location of fire hydrants,
lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane
signage.
c. The applicant shall submit the required financial guarantees and site improvement
performance agreement (SIPA) prior to issuance of building permits.
d. The applicant shall submit a reproducible 8 1/2 x I I inch "As Built" Fire Protection Plan
prior to the release or reduction of any required financial guarantees.
e. The applicant shall submit reproducible Mylar prints and an electronic copy (CD) of
sanitary sewer, water service, storm sewer, and pond As-Builts for the site prior to the
release of required financial guarantees.
