RESOLUTION 2008-145
APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR CHILD LEARNING
CENTER AT MOUNT OLIVET LUTHERAN CHURCH AT 12235 OLD ROCKFORD ROAD

WHEREAS, Mount Olivet Lutheran Church has requested approval of a conditional use permit
amendment to allow operation of a summer school-age care (SAC) program in the existing
building on property legally described as follows:
Parcel A:
That part of the Northwest Quarter of the Southwest Quarter of Section 14, Township 118,
Range 22, described as follows:
Beginning at the intersection of the North line of said Northwest Quarter of the Southwest
Quarter and a line 162 feet Westerly of, measured at right angles to and parallel with the East line
of said Northwest Quarter of the Southwest Quarter; thence Southerly parallel with the East line
of said Northwest Quarter of the Southwest Quarter a distance of 420.14 feet; thence Westerly
parallel with the North line of said Northwest Quarter of the Southwest Quarter a distance of 140
feet; thence Northerly parallel with the East line of said Northwest Quarter of the Southwest
Quarter a distance of 420.14 feet to said North line of the Northwest Quarter of the Southwest
Quarter; thence Easterly along said North line a distance of 140 feet to the point of beginning
except that part lying Northerly of the centerline of County Road No. 9.
Parcel B:
That part of Section 14, Township 118, Range 22, described as follows: Commencing at
intersection of the East line of Northwest quarter of Southwest quarter and South line of
Rockford Road thence West 8 rods, South 15 rods, East 8 rods and North to beginning.

The South 172.64 feet of the North 420.14 feet of the East 162 feet of the Northwest quarter of
the Southwest quarter of Section 14, Township 118, Range 22, also part of the West 30 feet of
the East 162 feet of the North 247.5 feet of said Northwest quarter of the Southwest quarter lying
South of County Highway No. 9.
Parcel C:
That part of the East half of the Southwest one quarter of Section 14, Township 118, Range 22
described as follows: Beginning at the Northwest corner of said tract, thence running East along
the North line of said tract 300 feet, thence running South parallel to the West line of said tract
500 feet, thence West parallel to the North line of said tract 300 feet to the West line of said tract,
thence North along the West line of said tract 500 feet to the point of beginning.
Also
All that part of the East half of the Southwest quarter of said Section 14, Township 118, Range
22 described as follows:
Commencing at a point on the North line of said East half of the Southwest quarter distant 300
feet East of the Northwest corner thereof, thence South parallel with the West line of said East
half of the Southwest quarter a distance of 24.18 feet, more or less, to the centerline of County
Road No. 9 as now laid out and traveled; thence continuing South along the last described course
a distance of 250 feet to the actual point of beginning of the tract of land to be described, said
point of beginning being the Southwest corner of that tract of land described in Book 2132 of
Deeds, Page 533, in the Office of the Register of Deeds in and for said Hennepin County,
Minnesota; thence East at right angles a distance of 180 feet; thence South parallel with the West
line of said East half of the Southwest quarter a distance of 327.39 feet, more or less, to the
intersection with a line drawn parallel with and 600 feet South of the North line of said East half
of the Southwest quarter; thence West along the last described parallel line a distance of 480 feet
to the West line of said East half of the Southwest quarter; thence North along said West line a
distance of 100 feet; thence East parallel with said North line of the East half of the Southwest
quarter a distance of 300 feet to the intersection with a line drawn South from the actual point of
beginning parallel with the West line of said East half of the Southwest quarter of Section 14;
thence North along the last described parallel line to the actual point of beginning.
WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mount
Olivet Lutheran Church for a conditional use permit for property located at 12235 Old Rockford
Road, subject to the following conditions:

2. A copy of the State of Minnesota Department of Human Services license for this property
shall be submitted to the City.
3. Separate building permits are required for any interior building modifications.
4. Signage shall comply with the sign regulations of the Zoning Ordinance.
5. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
6. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof
shall be grounds for revocation.
7. This approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
