RESOLUTION 2008-113
DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT
STATEMENT (EIS) BASED UPON REVIEW OF THE ENVIRONMENTAL
ASSESSMENT WORKSHEET (EAW) DATED JANUARY 30, 2008 FOR THE
PROPOSED PLYMOUTH CREEK WATER QUALITY PONDS
CITY PROJECT NO. 3105
WHEREAS, the Planning Commission has reviewed the Environmental Assessment
Worksheet (EAW) for the Plymouth Creek Water Quality Ponds (3 105) on March 19,
2008; and,
WHEREAS, pursuant to Minnesota Environmental Review Program riles, the City of
Plymouth, acting as the responsible governmental unit, prepared and distributed an
Environmental Assessment Worksheet (EAW) for the Plymouth Creek Water Quality
Ponds Project (3 105) on February 11, 2008; and,
WHEREAS, the 30 -day review period expired on March 12, 2008, and all comments and
recommendations received from reviewing agencies and other interested parties have been
considered; and,
WHEREAS, it has been determined that the proposed project does not present a potential
for environmental impacts of such significance that an Environmental Impact Statement
would be required;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does make a
Negative Declaration on the need for an Environmental Impact Statement (EIS) for the
proposed project known as the Plymouth Creek Water Quality Ponds (3 105) based on the
Record of Decision and subject to the following conditions:
1. Compliance with all statements in the attached Record of Decision.
2. Wetland mitigation shall occur as required by the appropriate permitting agencies.
3. Strict adherence to the City's Erosion Control Ordinance shall be met during
constriction and until the site is re -vegetated.
