RESOLUTION 2008-095
APPROVING A PUD GENERAL PLAN FOR WB GYMS, LLC FOR "GOLDS GYM", A
FITNESS CLUB ON PROPERTY LOCATED AT 1605 COUNTY ROAD 101 (2008007)
WHEREAS, WB Gyms, LLC has requested approval of a PUD general plan for property legally
described as follows:
Tract C, Registered Lane Survey 1301, files of the Registrar of Titles, County of
Hennepin.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by WB
Gyms, LLC for a PUD General plan, subject to the following conditions:
1. A PUD general plan is approved to reuse the existing building for a Gold's Gym fitness club,
according to the plans received by the City on January 24 and February 26, 2008, except as
amended by this resolution.
2. Approval of this PUD general plan is contingent upon City approval of the associated
rezoning.
3. Development standards shall be as indicated on the plans dated January 24 and February 26,
2008, except as amended by this resolution.
4. No building permits shall be issued until a PUD final plan is submitted to and approved
by City staff.
5. As part of the PUD final plan application, the applicant shall submit the following plans
and materials consistent with City requirements:
a) Revise the plans to show that the trash and recycling dumpster would be stored within the
building or that a new dumpster enclosure would be constricted;
b) Submit a sound source control plan demonstrating compliance with the City's noise
ordinance;
c) Submit a lighting plan or other agreement stating that side shields would be installed on
the parking lot fixtures.
6. Prior to issuance of a building permit, the applicant shall execute a site improvement
performance agreement and submit the applicable financial guarantees.

7. The hours of operation for the fitness center are hereby restricted to:
a) 24 hours from Monday at 5:00 am through Friday at 12:00 pm, and,
b) Saturday and Sunday 6:00 am to 10:00 pm.
8. The parking lot light fixtures on the north side of the site shall be turned off at 11:00 pm
Monday through Friday and all parking lot fixtures shall be shut off after 10:30 pm on
Saturday and Sunday.
9. All signage shall require separate permits and shall be in conformance with the requirements
for commercial districts as defined in the Zoning Ordinance.
10. All garbage and recycling shall be stored consistent with Zoning Ordinance requirements.
