RESOLUTION 2008-094
APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED AT 1605
COUNTY ROAD 101 (2008007)
WHEREAS, WB Gyms, LLC. has requested reclassification of the zoning from C-2 to PUD for
the 3.74 -acre parcel located at 1605 County Road 101, presently legally described as follows:
Tract C, Registered Lane Survey 1301, files of the Registrar of Titles, County of
Hennepin.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval; and
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from C-2 to
PUD.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for
reclassification of the zoning from C-2 to PUD for the 3.74 acre parcel at 1605 County Road 101,
based on the following findings:
1. The proposed development is consistent with the C land use designation on the
Comprehensive Plan land use guide plan map.
2. The proposed development would meet the purpose and intent of the PUD zoning district by
providing a controlled mix of commercial uses on the property.
3. There is adequate infrastructure to serve the proposed development.
4. The proposed development would add to the existing landscaping on the west side of the
property to better screen the parking area for the adjacent townhouses.
