APPROVING A SITE PLAN AMENDMENT AND VARIANCE TO ALLOW A 108,017 -
SQUARE FOOT BUILDING EXPANSION FOR US FOODSERVICE LOCATED AT 9605
54TH AVENUE NORTH (2007111)
WHEREAS, ESI Design Services, Inc. has requested approval of a site plan amendment and
variance for a 108,017 -square foot building expansion located at 9605 54t1i Avenue North, for
property legally described as:
Lot 1, Block 1, Scherer Industrial Development, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by ESI
Design Services, Inc. for a site plan amendment and variance, subject to the following conditions:
1. A site plan amendment and variance are approved to allow constriction of a 108,017 -square
foot expansion, in accordance with the application materials received by the City on
November 26, 2007, and revised plans received on January 22, 2008, except as amended by
this resolution.
2. A variance is approved to allow metal wall panels as the exterior finish for the cold storage
building addition and machine room addition, where a maximum of 50 percent of this exterior
material may be used as required by the Zoning Ordinance, based on the finding that:
a. The building addition would be separated from residential use by a new pond, the addition
of proposed overstory trees, and by the intersection Nathan Lane and 54t11 Avenue North.
The addition would meet building setback requirements and would continue the same

north setback as the existing building along 54"' Avenue. The applicants are proposing to
constrict the addition with materials and a design to match the existing building.
b. The conditions relating to the hardship are not generally applicable to other properties in
the I-2 zoning district. There are few cold storage additions in industrial districts in the
city. The variance is requested to allow a material with the insulation properties needed
for cold storage to occur. The building addition would be set back roughly 230 feet from
the closest residential home to the northwest.
c. The hardship is caused by the Zoning Ordinance and has not been self-created. The
exterior finish requirement was added to the Zoning Ordinance in 2001, after the
constriction of the building with metal wall panels.
d. The variance would allow a reasonable use of the land and would not be detrimental to the
public welfare or injurious to other land in the neighborhood. The addition would not
impair an adequate supply of light and air to adjacent property, endanger public safety,
increase congestion of the public streets, increase the danger of fire or substantially
diminish property values in the neighborhood.
3. Separate building permits are required prior to commencement of the project.
4. Prior to issuance of any building permits, the applicant shall:
a. Sign all plan sheets.
b. Complete a site improvement performance agreement and submit a financial guarantee
pursuant to Section 21045.10 of the Zoning Ordinance.
c. Submit a revised lighting plan in compliance with the shielding requirements of Section
21105.06 of the Zoning Ordinance.
d. Obtain all appropriate permits from: 1) Minnesota Pollution Control Agency; 2)
Minnesota Department of Health; 3) Shingle Creek Watershed District; 4) Minnesota
Department of Transportation, for drainage; and 5) NPDES.
e. Revise plans showing B612 curb and gutter in the parking lot.
f. Provide a method to isolate and test all new water mains per the plumbing code (200 psi
for two hours).
g. Revise plans to show all water main material as C900PVC. Ductile iron pipe is not
allowed.
h. Revise plans to show the fire lane constricted per City detail STRT-8. Revise note on
CO3 to reference sheet C06 for detail.
i. Provide a minimum of 12 inches of freeboard from the lowest building opening where
storm water may enter (door or window) for the overland emergency overflow (EOF).
The proposed building expansion on the northwest portion of the site currently shows
0.47 feet above the EOF. One option is to lower the drive aisle to achieve the required
freeboard.

j. Provide a reinforced spillway (rip rap with filter fabric or turf reinforcement mat) at the
emergency overflow location for both water quality ponds.
k. Provide a maintenance agreement for the underground storm water treatment device and
the pond located in the northeast portion of the site.
1. Provide a manhole at the upstream portion of the underground storm water system for
inspection and cleaning purposes.
m. Revise the landscaping plan (sheet 1-101) to reflect no seeding or plantings below the
normal water elevation for the water treatment ponds.
n. Clearly show silt fence locations on sheets CO2 and C12, and in the legend. Also show the
location of the required concrete trick washout station on sheet CO2.
o. Check the invert elevation of 906.06(S) for OCS-10. It appears incorrect. The existing
downstream catch basin it ties into has an invert elevation of 914.36.
p. Revise plans to show the storm sewer pipe between OCS-10 and FES -9 as ductile iron
pipe and not high density polyethylene extruded pipe as shown. Also, remove the flared
end section and rip rap for FES -9. It is not needed because it will be under water. Revise
the casting schedule on sheet C 11 to reflect this change.
q. Revise plans to show the storm sewer pipe between OC S-2 and FES -1 as ductile iron pipe
and not high density polyethylene extruded pipe as shown. Also, remove the flared end
section and rip rap for FES -1. It is not needed because it will be under water. Revise the
casting schedule on sheet C 11 to reflect this change.
r. Revise plans to show high density polyethylene extruded pipe or reinforced concrete pipe.
The current proposal shows that nine feet of 12 -inch corrugated metal pipe would be
added to the existing storm pipe south of the fi ture building expansion on sheet CO3. The
City does not allow corrugated metal pipe for the pipe extension. Also, a manhole is
required to make the transition and clarify why the storm sewer pipe is necessary.
s. Add clarification on sheet CO3 regarding the reference to the City requirement for
inspection and video inspection of all storm sewer pipe, that City inspection and video
inspection shall apply on pipes larger than four inches in diameter only. One exception is
that a video inspection is required for the underground storm water system.
t. Add a note that references the requirement that the proposed watermain gate valve
located east of Nathan Lane shall have one fill pipe installed past the gate valve
(minimum).
u. Revise plans to relocate the proposed watermain gate valve (shown east of the
underground storm water system) to connect at the existing watermain.
5. Fire Conditions:
a. Relocate hydrants to approved locations on the east and south sides of the south building
addition.
b. Identify hydrant locations on the south and west sides of the existing building and the west
building addition. Additional hydrants and relocated hydrants may be required.
c. Identify the post indicator valve location for the south and west building additions.
d. The site hydrant system must be a looped system with two separate connection points on
the street watermains.

e. Submit turning radius evaluations for all Fire Department apparatus on all fire lanes from
the north parking lot and the west trick area. Fire Department approval is required.
f. Submit security gate information so that the Fire Department has access through the gates
on the property. Fire Department approval is required.
g. Fire lane signs are required in approved locations on all site drive aisles, fire lanes and at
all fire department connection locations. Sign locations will be identified by the fire
inspector on the site plan.
h. The Fire Department connection locations for the building additions must be approved by
the fire inspector.
6. The minimum floor elevation shall be 921.97.
7. Silt fence shall be installed prior to any constriction on the site.
8. All rooftop equipment shall be screened or painted to match the building.
9. The applicant shall comply with the noise requirements of Section 2025 of the City Code.
10. Standard Conditions:
a. The applicant shall remove any diseased or hazardous trees.
b. New signage shall receive sign permits when required and shall comply with the Section
21155 of the Zoning Ordinance.
c. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
d. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
e. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning
Ordinance.
